Hi,
I apologize if I am asking a repeat question.
I received my green card a few months ago but my family haven't received their's yet. As a result they are still using EAD and/or Advance Parole documents. I am considering a job change and in that context I have two questions:
1. Are there any gotchas that I should be aware of - given that my family's cases haven't been approved yet.
2. If I do change jobs, can I apply for EAD and Advance Parole documents for my family on my own? Meaning, without going through the employer.
Thanks for your time.

Former Supreme Court Justice Sandra Day O'Connor, appointed by President Reagan, recently made comments on the new law in her home state of Arizona: In a question-and-answer session after a speech to alumni at St. Ignatius College Preparatory School - from which her late husband, John, graduated in 1947 - O'Connor avoided passing legal judgment on the far-reaching law, which would make it a crime for immigrants to be in Arizona without valid residency papers. Still, she said, Arizona 'may have gone a little too far in its authority, in encouraging local law enforcement officers to take action' against anyone...

Hi everyone,
I have just received my H1-B, and I'm planning on a two week vacation back to my country.
I'm not on a good relationship with my company at the moment, and even if they granted my vacation, I'm afraid they might cancel my H1-B visa while I'm on a vacation overseas.
If they do, would I be not able to come back into US, or would they at least give me a few days to pack up my stuff?
Any advice and comments would be appreciated.
Thank you for your time.

If your I-140 is approved then you can renew H1B for 3 years, else it will be in one year increments.
You can continue to keep h1B as long as an underlying GC application is pending.

On February 18 and 19, the University of California (Irvine) hosted a symposium where many of U.S. immigration's Rock-Star professors came together to try and solve "Persistent Puzzles in Immigration Law." The topics covered a wide expanse. A subject discussed that particularly interested me is Congress's often inexplicable delegation of regulatory authority among a surfeit of federal agencies that administer and enforce the immigration laws, each with its area of real (or presumed) expertise and overlapping responsibilities. One speaker mentioned her concern about the possible mis-use of E-Verify by some employers to screen current or would-be workers for employment eligibility,...

Hi,
My sister is a citizen and she applied GC for my parents who are in India. She applied for I-130 in April and it was approved in 2 months. She now has to fill the form I-864 and is in the process of doing so.Meanwhile my parents would like to visit USA.They'll be coming in December and be staying for 6 mos. They have a 10 yr visa and visited us back in 2004.
My question is it ok for them to visit USA?I read that they might be denied entry becasue of their approved I-130.We do not want to apply AOS here and they will return in June 09.
Thanks for any advice.

I'm Australian and would like to return to the U.S. to visit in-laws with my partner but I overstayed my visa on my last visit.
On my last visit, I received a 6-month visitor visa then extended my visa another 6 months. I overstayed my visa by 11 weeks; I was helping my same-sex partner move. This was two years ago. I did not work for anyone while in the States.
What can I do if any to improve my chances of not getting turned away at Immigration?
Thanks for any help.

I have been a silent user of IV for a very long time. When the Action item came for FOIA, I was wondering why such important information is buried in several threads. Then I started looking around in the IV site and found Action Alert button in home page. I saw this button for the first time after using IV for months and months. I just jump into the forum and start reading. I believe this button is not so obvious and it doesn't grab attention.
I think Action Alert is the first thing that users should see, so that they can know what IV is doing and how they can contribute.
IV core team / pappu - Could you please consider renaming this button and moving it so that it is very obvious to all users.

My situation is: last entry to US with F1 visa as a student. After graduated, got H1 visa, but didnt leave US during the period.
When filling I485, need to answer the following questions.
1. In what status did you last enter?
For my case, should I fill F1 here.
2. Nonimmigrant Visa Number, Consulate where visa was issued and issue date?
Does this refer to my H1 visa number? If so, since it is not issued by consulate, how I can answer the last two questions?
Thank you veyr much.

At a time of historically high unemployment rates, when it becomes convenient, even fashionable to highlight the frailties and abuses of the H-1B program, it is refreshing to take note of the feel good story of certain immigrants who have come to this country and achieved greatness and are living the American Dream. Indeed, the recent Nobel Prizes awarded this week to the first six (6) Nobel Laureates were to U.S. citizensfour of whom were born outside the United States. Perhaps we should take a closer look at the current popular theme of closing our borders to protect U.S. workers....

I have one 485 filed through EB3 with priority date of June 2004. I have another labor and I140 filed through a differentr employer in March 2005. I140 for that is approved. But when I filed the 140 I did not get the priority date transferred to the new I 140. So the second 140 has a PD of March 2005 which is not current. Can I apply a second 485 by porting the PD of my earlier 140 and apply for 485 now? What document do I need to submit for porting the PD?
Thanks and appreciate your time.

Hi,
I am applying for Citizenship after completing 4 years and 9 months as a Permanent Resident in US.
Can any one please let me know as what is the processing time to get the Citizenship after I apply?
Also I have planned to move to a different State after I apply for Citizenship.
Please let me know whether it fine to move to a different address after applying for Citizenship? Else is this move not advisable?
Does this address change delay my Citizenship processing time?
Appreciate your guidance.
Thanks.

The early retirement of US Senator Mel Martinez (R-FL) has opened up an appointment opportunity for Governor Charlie Crist, himself a candidate for Martinez's seat. Crist will likely not appoint himself and a number of names are circulating for potential replacements. According to Politico, one person being considered is Jacksonville-area State Representative Jennifer Carroll. Carroll would be the first black female Republican Senator if she were selected. Carroll is a native of Trinidad and a retired US Navy officer. Carroll's immigration positions aren't clear from her record, not exactly a surprise given that state legislatures don't consider very many immigration...
