Hello every1,
A SVP of 7 equals 2-4 years of education/training or experience (A job zone of 4 is treated as an SVP of 7.0 < 8.0).
A SVP of 8 equals 4-10 years of education/training or experience (A job zone of 5 is treated as an SVP of 8 & above).
A MS Degree is calculated as equal to a BS +2 or 4 years experience and no education.
NOW, BS + 5 / MS + 0 -- Minimum qualification for EB2..
So now a person working in Job Zone 4, which requires minimum of BS + (2-4) experience would get an entry level job at OES Level Wage 1.
So Can we conclude from this that a job which falls under job zone 4 which needs to applied for EB2(basically raise SVP to 8) would have a minimum OES Level 2 wage ????

If H4 uses EAD for work with 485 pending, and if the underlying I-140 gets rejected, will this make H4 holder be out of status? what are the options for H4 holder.
If I 140 is rejected then the EAD,AP and I 485 are rejected as well. If you have used EAD then ur H4 is no longer valid ! You will have to go out of the country and get H4 stamped.
So the recommendation is to keep H status alive till you get Greencard

We like to share that the H1B cap is extremely close to being reached. The count as of December 15, 2009 is 64,200. This is 1300 cases more than the count from December 11th. This count is very close to the total cap of 65,000 which is actually somewhat reduced by numbers allocated under trade agreements. We continue to watch this very closely, and will provide updates until the FY 2010 cap is reached.
We suggest to act quickly to avoid last minute embarrassment as H-1B Cap may soon be cease to exist.

In addition, approximately 20,000 U.S. Master's or higher petitions (i.e. advanced degree petitions) have been received. Any advanced degree petitions received from here on out will count toward the regular cap of 65,000. The USCIS is still accepting petitions at this time, but it is advised that any H-1B petitions be filed as soon as possible as the USCIS could announce that the cap is closed at any time.

Please I need advice. I am currently preparing to file I-140/I-485 concurrent application and do not want to include the names of my children who are US citizens on the application. This is because I do not want the name of their mom to come up since I don't want to add her name too to the application. Although we got married outside the US, and I mistakenly wrote that with her name on my B1/B2 application I still will want to file this application as single. She has some issues to clear with USCIS and I do not want to complicate matters by adding her name to my application. I truly will appreciate your advice on this matter before I submit my application. Thank you

Opponents of Arizona's SB1070 immigration law scored another victory in the courts yesterday. In the case of Friendly House v. Whiting, the court overruled a motion to dismiss the case challenging the law. The judge noted that "Racial discrimination was a motivating factor for [S.B.] 1070�s enactment" which establishes a legitimate constitutional challenge to the law. While this is only the opening round in the case, it does suggest that the defenders of the law will have a tough time convincing the judge that the law is constitutional. 10-1061-447 -

I was just wondering why legal immigration is not generating any interest with the beloved politicians in this country. Inside the mind of these politicians... I guess their agenda is very clear.
Immigration support for illegals = hispanic votes = reelection!
Immigration support for widows = sympathy votes = reelection!
Immigration support for same sex partners = more votes = reelection!
Immigration support for serving the military = Show of patriotism = society respect!

But,
Immigration support for legal immigrants = what's the use = not a penny worth!!!
Oh God help us!
