You are correct. Upon corresponding with Ombudsman's office, their response was also the same. Although they added we can expect an approval by end of the week. Good hing we already have an Infopass appointment scheduled for Friday morning. Do you think we should "demand" and Interim EAD or an "approval email" be provided - something my wife can carry with her on Monday to the firm that is willing to hire her? Do you think they would be nice enough to issue the "approval" email?
Infopass depends on officer, some are nice... nice in the sense they do one step further to help us. Some are just reads through the lines and repeat what we know. I would call it lucky to get expedited or any means via infopass. Only option is ask them to call NSC and check on status. That might help or even email if required. Employers generally dont ask for approval email or treat it as an approval you need to wait till the card. if that would be so we wouldnt be in this problem in the first place.

Would you please tell me your "Receipt Notice" date. Mine is Dec-28. I mailed my application on Dec-17th. I am still waiting for my AP (only 4 days left for my travel).
I may be able to get an idea from your input. Thank you.
If your travel is due to any emergency or an important/urgent purpose, you can go to the local USCIS office with documentation to justify the cause.
My cousin had his AP, it was called something else and was on white paper unlike the normal AP, given to him the same day.

Hi All,
This is my first post as I just came across this site while googling after my GC process got stuck once again. The details of my case are below, basically they finally started moving on labor certification in Dec 2006. All steps were completed and it was sent for approval in April but no word since then. The lawyer says it is on someones desk who is on sabatical or on leave and does not know how long it will be. It makes it more frustrating as more than 5 people in my office started the advertising phase in Arpil and completed labor cert by June.
Has anyone else had a similar problem at this stage of the process. After 6 years I am still not through the first stage of labor cert and the patience is running low.

Does IV has official data from USCIS on how many EB visas were wasted? What if USCIS says we did not waste any EB visa after CIR? Do we need to do an FOIA for this?

I just called USCIS to check on my case status, the Cust rep over there told me as below.
Details of my case-
My PD - July 2005
EB2
USCIS received my 485 appln on July-2-2007(according to fedex) according to USCIS myaccount portfolio they received it on Aug-10-2007.
She mentioned that my case was 41 days over due (that means my case should have been looked at 41 days prior to today, no clue why and she didnt know either) so she opened up a SR and said that an IO will look into it.
She didnt have info on whether my namecheck/background check was complete etc....
Lets see how things go
If there are any who have called, pls share your exp.
Good to know that NSC is going by RD and not ND. also suggests that they might be looking at the PD as well when determining the order in which applications are picked. I didnt see any 'legislative clauses' to guide the same - So it is more of 'practice' than law - So USCIS can change this (order of adjudication) at their discretion - so I think.

This is crazy. Air India website says ATV is required for Advance Parole holders.

Our argument about using additional visa numbers from regular quota , due to amnesty is correct and justified. So Can we work on the proposal to get some additional visa numbers due to amnesty. I know, these days it is very tough to increase visa numbers. But our argument is also not wrong. We are suffering due to these additional visa numbers being used from our stipulated limited quota of 140,000.

Do you have an old AP that is valid till Sept 19,2010. If then you are good. The IO has done it right. If you apply for renewal, then they will extend from the expiry of the old one. This was the case for me last 3 times, but this time, the approved on July 11 and made it valid one year from approval date and I lost couple months due to this.

:cool:The idea that comes to my mind all the time is if Congress wants to keep the per country limit for GC ( even in EB categories) then they should understand that India China are almost third of entire humanity. So for GC purpose they should split India and China into states of birth as well . Just look at it Uttar Pradesh with a population of 16 crores can become 6th largest country in world on basis of population. Then we have AP, Maharashtra, Gujarat etc. That will automatically increase numbers for all of us and still keep the country limits. Plus it will in true sense bring diversity from these two countries which are right now dominated by few states both in FB and Eb categories. Please dont get angry if you dont like it. Just a wild idea which will perhaps never be implemented but food for thought

Hate to be the party pooper, but its better to see the reality than be lost in the illusion. The facts:
We a have bitterly and an acrimoniously divided Congress
The democrats are NOT together on this one i.e blue dogs, conservative Dems etc.
We have game changing mid terms coming in.
Democrats DONT have super majority in the Senate any more.
And MOST of all we have a president who has PUBLICLY said that this bill will not pass this year due to the lack of political clout.
This is just a ploy to rally up the hispanic votes by Reid, don't pin too much/any hopes on this, the writing on the wall is unfortunately very clear, not worth the heart break. :(

My lawer said that DOL told them that they do not have a system in place yet to check the case status. They do not anticipate that they will have a system in place until they are able to issue 45-day letters on all applications, which they anticipate will be by the end of June 2006. Even at that point, we do not know how quickly they will be able to implement a system to provide information on processing times. My lawer also said that they will notify me as soon as they receive any additional correspondence from the Department of Labor regarding my case.
Bottom line my manager still do not have to do anything, becuse he does not have any instructions. Long, long time of waiting ahead ;-(

My approved I-140 is getting revoked becaude USCIS is saying they didn't verify ability to pay 2.5 yrs back and asked for more docs.
Neednot to say, I switched employers 2 yrs back and switched to EAD thinking everything should be safe.
This is the second time this year that my I-140 is being revoked. In feb,07 my i-140 and 485 was revoked because USCIS ignored AC21 and never asked me anything about AC21. I filed MTR and got it reopened in May.
In nov this another mess.
My case is at Vermont and it appears either the officer is retaliating or is ignorant.
I know this is unprecedented but i am broked down and fed up of fighting them. It has been a never ending journey for my family.
I have submitted all my the documents and don't know whats going to happen.
Any advice from the community will be helpful as I don't know what to do.
Another thing, i used VP office for clearing namecheck which was done on Nov2 and this I-140 revoked on Nov 8.
I am on my 3rd EAD.

I am sorry for those who used EAD and thought they are safe. :( :( :(
This means we should never depend on EAD after filing I485. Always stay on H1B.
It will hurt a lot of people who said EAD is like a greencard . Now their attitude will come back to bite them.

Lots of negative things going on for immigrants with government agencies. I felt the forums were going to start heating up with issues.
I thnk overall people have started to give up on USA. USA does not represent a "GOOD LIFE" anymore..and the reason is for everyone to see. Even with a GC the way things go you might lose your job and God Forbid .. but if you are hit by a serious illness and you have mortgages to pay you can end up homeless..not much fun eh?
