If a person is on dependant visa (H4) and applies for green card with their spouse's green card application, can they apply for H1 as well?

Immigration and Customs Enforcement Assistant Secretary John Morton announced today that the agency will inspect the I-9 records of approximately 1000 companies around the US, dwarfing the announcement in July that nearly 600 firms were being investigated. Hello -
I am currently in US on L-1B that is expiring on June 15th 2010. I am planning to travel to India and return to US around May 10th. That will be around a month from the date my visa expires. My question is will I face any problems at the port of entry upon my return? I am needed on an assignment in US until Aug 2011 and so my employer is planning to file an extension as soon as I return to US.

USCIS reports that 1000 H-1Bs were receipted over the past week with 34,500 now counted. 400 masters cap cases were added bringing the total to 13,000 in that category. That's about on pace with the last several weeks and the exhaustion target in that category remains February 2011. My methodology is simple. My I-485 receipt from USCIS does have my priority date listed. In fact, they even say on the receipt that the priority date listed might not reflect the oldest priority date that you might be eligible for.

Delaware Immigration Lawyer Blog Has Just Posted the Following:
B-1 visa is for the visitor who has an unabandoned foreign residence, intends to visit only temporarily and intends to engage only in permitted business activities.
B-1 business visitor may be admitted for the purpose of enaging in business but not for the purpose of local employment or labor for hire. in distinguishing, the determination would be whether the principal place of business and actual accrual of profits are in the foreign country. Permitted business activities may include
Engaging in commercial transaction which do not involve gainful employment
Negotiating contracts;
Consulting with business associates; and
Participating in scientific, educational, professional or business conventions, conferences
B visitors may apply for extension of stay in six month increments and may change to other non-immigrant visa statuses.
