    Let me take it a step further.
    If the information is stored as a segregated flat file, it won't take that long.
    One could just proxy a perl/java gateway and write a script to parse data.

    Who does it.. make all the difference.

    K, I did not intend to get into a technical discussion here, When I made the initial post. There are issues at government agencies beyond the technical nitty gritty and my post was to point out that the skill set required is not the SQL/CRM of today. Suggestions such as we can offer expertise in return does not go any where as the systems on which the databases reside are not playgrounds, where we can write code and extract what ever we want. There are change control issues, security clearance issues, just to name two on top of my head. The total time for response is not just the time it takes to develop and run a computer program and provide us results. There are administrative issues at different level of abstractions at every org and CIS sure does have a bit more of that. All these consume time. At this point, the NRC response does not indicate time but indicates cost. We are trying to find the total time it takes to send a response back to us. Based on the response time, further action needs to be taken. It is illogical and absurd to just keep thinking technically. Take of your techie hat and think beyond. All comments in jest!

    For those who are wondering big time that the country of charge ability/nationality is not captured in CLAIMS, you must have missed that stake holder meeting in which CIS clearly mentioned that it will take lot of $$ to re design their system to capture biographic information and will not be able to do so. Well, what can you say, even after raising the fees by 100% CIS does not have the money to serve beneficiaries who keep filing their flagship cash cow applications such as I-131/I-765. If some one still have the link, please post it.

    The original bill had a 10% per country cap. Don't think that has been removed in the new bill.

    You have a great plan, come to US on H1 and within 6 months get EAD and you are free from H1b crackdown by jumping to EAD. You think USCIS, Grasley, sanders, and anti eb folks are a bunch of idiots, they will send you and me packing with the same rfe they are hitting h1 folks with if everybody gets to pre file AOS and get EAD. that is why you need to strengthen ac21 by removing same\semilar job condition and other potential h1 like rfe's, otherwise you will drag us down along with you and turn ead into h1.

    Anyway I have made my point in this post and all my previous posts. ASK anybody who has been waiting for last 5 to 10 years without GC If what I said is wrong or laughable. I am not one of those bitter folks who says its my way or the highway. Good luck to you guys.

    Now it's clear. You don't want people to drag you down, even when they have had gone through everything, Labor, I-140, been in the country for 10 years, etc. -- I thought you had a noble cause from the older posts, but apparently I was wrong.

    This also started getting ridiculous. In my own post, and agreed by almost everyone else, I specially said to put on restrictions to those who can file AOS, e.g. with I-1140 approved, or with a PD older than a certain number of years. Where did you get the impression that every H1 can arrive this country and be on EAD in six months? Why did I found that the extreme generalization and scare tactic employed by you has an alarming resemblance to those from Lou Dobbs and Grassley?

    And to answer your last question, even with a PD of 2007, I've been in the US for ten years, but could not file green card due to company bankruptcy, layoff, etc. and I am 90% certain you've been here shorter than I am. Then should give up your EAD till everyone who stays here longer than you does?

    Just a question, why is everyone so happy that the CIR has Failed and more importantly why does everyone on here feel that if CIR is resurrected it will "haunt" us?

    If CIR fails to go into "production" this year, is it not true that we have ZERO reform? I mean would it not be better to ride this wave and try and sneak our provisions into the mix rather than SIMPLY feeling happy that CIR is "dead"?

    At this point (even after the PD movement), About 70% of us are still in the retrogression mess and will continue to be in that mess till SOME immigration reform passes. So the question then is: Should we not be trying and praying that CIR passes WITH our provisions (and i know how hard the core team is working and hence i am asking this question). I mean the core team has given an infinite amount of time and energy to this project. Would it not be easier to see a bill finally pass and try and get our provisions in this bill rather than killing this bill?

    On a lighter note, I did watch sausages being made, and I can't eat them anymore.

    That's why there is a saying that you should never watch sausages and laws being made.

    The Cantwell amendment and Lieberman amendment will fail to pass the vote. It doesnt matter whether its ordered to lie on table or whether its ordered to take a nap on the table or have some lemonade on the table. And it doesnt matter what any of those "Motion to... " means.

    Both of those amendments, if debated, will fail. It will take 10 seconds for Bernie Sanders, Ted Kennedy and Dick Durbin to scream on top of their lungs and kill it. And the reason is very simple. There is a massive H1B exemption ON TOP OF 180,000 QUOTA. People who have been so successful this year so far in restricting H1 and employment based GCs are not going to miss that nice little H1 exemption at the bottom of both these amendments. So stop scratching your heads over what the "lying on table" means, because whatever is lying on table is unpassable if it somehow awakes from the table and starts dancing in the well of the senate floor.

    It is amusing to see that there are quite a few people who want the very door closed that they used to enter. It is even more amusing to see that the fault is always someone elses. It is similar to all the people who are opposed to immigration because it is someone elses fault that they are losing their job. Down right funny :p.

    We need to focus on solving our problems without blaming others for our problems. Because once we go down that lane, we are no better than anyone from NumbersUSA or any other organization/ people who are against immigration. It is OK if we do not support increasing H1B - but saying that the H1B program needs to shutdown is not correct. I am sure that one can reason in the same breath that the EB3 category needs to be eliminated so that retrogression can truely be eliminated :eek:

    I am proposing that it is better to completely eleminate EB3 than
    having some kind of false promise of GC.
    I know lots of IT guys from India fall for the Green card promise form employers even now (they say I applied and I should get in 2 years or so..
    what should I say to those people)

    By the way I am not "really" asking for H1B to be shut down. I am saying H1B
    in its current form should be shut down. Obviously when the time comes
    to actually shut it down, Corp America will panic and fix the problems.
    In US, if Corp America really wants they WILL get it done.
    In a presidencial election, a canadiate needs close to 100 million.
    A senator needs around 2 million for an election.

    Congressmen need lesser money and thats why they are more listening to local population (and oppose any H1B /EB etc) and can afford to oppose Corp America.

    making illegal a felony and also a fine 50000$ per illigeal worker employer
    employed it was the american chamber of commerce that took out the
    big guns and ofcourse their surrogates/supporters orgaised those

    I�m working for company A and company B has sponsored my GC as future employee and also did a H1 transfer from A but got a big RFE. Now company C is ready to do H1 transfer. Is it a good idea to do so or would get into problems as GC is in process through B? We did I-140 & I-485 concurrent filing and got our EAD�s approved but I-140 is still in pending status. I heard that using EAD is not a good idea when I-140 is pending.
    My Attorney is sending a response to RFE but I�m not sure whether it gets approved or not. What happens if B transfer gets approved and would choose to work with B and not use C at all (if it gets approved)?
    In the other way, If C gets approved and choose to work with them as the H1 with A expires pretty soon (got to move out) can I comeback to B with a fresh (another) H1 transfer. Please suggest what is the best to do at this time?

    Again what is the point in moving to Canada just because you are tired in waiting here. Are you going to do the same job in Canada. If yes, I would do that here.

    For me, only person who could move to Canada is:
    1. Way better career jump.
    2. Do not have wavery mind of coming back to US. If happens come back, but do not start with that as you will not lead happy life.
    3. Keep the GC processing alive in US.

    I think Canada might be a good option for some ppl. Here are some reasons:

    You move to canada, have greater flexibility to change jobs, your wife gets to work, in the meanwhile your employer lets the GC process continue. This way, you live a free life until you get a GC. But I seriously doubt if any employer will continue to process GC if you leave the country.

    Or you have waited long enough and are too tired to wait any longer. You would rather be elsewhere. In this case it doesn't matter where you go, Canada or back home.

    Another good reason can be that you have waited for 8-10 years in US and have no hope in sight. You are not tired but you can clearly see that the wait is completely futile and you are just hoping. You have decided to stop waiting but still want something that's close to US standards. And I think canada still comes very close to good standards.

    What do you guys think?

    sorry but this is ridiculous. If the US has a skill shortage and wants foreign workers, it should ensure that the foreign worker and his/her family are given the same rights that a domestic workers family enjoys.
    If they can't give that right, why do they want to invite the foreign worker at all?
    Its true that they are not forcing this on us and we are free to go back anytime. But still isn't the inequality pretty clear here? and this country is supposed to be all about equality...

    I agree with you. This policy basically amounts to treating "skilled labor" as some inanimate robots with no emotions or needs whatsoever. If H4 folks are free-loaders, then so are the dependents of EB green card holders .. after all the dependents didnt go through labor cert, did they ? As for the equality hogwash, I have long stopped believing that .. it exists only technically; but reality is what is staring us right now .. retrogression for coming countries with large number of skilled people, backlog "elimination" centers and infinite waits to be given any meaningful rights. Why ? simply because we were idiotic enough to believe all this "meritocracy" and "equality" propaganda.

    The problem with Per Country limits makes no sense when the same theory is applied to visa's granted because of Skill. Employability has nothing to do with ethnicity (in fact, there are laws that prevent this type of discrimination by employers). It just so happens that currently India and China, due to their educational focus has a lot of people with skills that American industry wants. Who knows, in 10 years this could change and those skills could come from Mauritius and Lichtenstein and then they would be backlogged instead.


    Franklin; I agree that per country quotas are discriminatory.

    What I am unsure about, is whether it is morally justifiable, and this hinges on whether it actually benefits the United States or not (many forms of discrimination against non-citizens are perfectly legal under the US constitution).

    I agree with Hermione, that given the current minuscule quotas the issue is moot (in fact, it was my intention to suggest exactly this, by pointing out that the last thing anyone needs to worry about is per-country quotas when the overall immigration levels are so tiny, and the per-country cap is so small).

    I am still on the fence, though, about the moral acceptability of per country quotas in the presence of rationale visa allocations (somewhere around 3 million per year by my estimate). I think at those levels (and with perhaps completely different percentages for the per-country quota) there may indeed be a moral justification (I simply don't know enough about cultural/social dynamics).

    I think everyone would agree that the US is certainly entitled to determine how it develops culturally (as is any country).

    In its present form of course, the immigration system is damaging the United States (e.g. RBD), so it is impossible for it to be morally acceptable from the US perspective (you can't balance the negative moral implications of discrimination against non-citizens, with the benefits to the citizens of the nation, when there are no benefits to the citizens of the nation).

    Significantly, it is most likely true that the present immigration policy is morally acceptable from (say) India's perspective, since it is resulting in improved retention of brain power for India...

    Congratulations to everyone whose dates have become current. To all gurus. I wanted to know as to how does it work when it comes to procesing I - 485, what dates are important is it the filing date, or the Priority date? If two people file at same time with different priority dates who gets priority, one with earlier priority date or one with earlier reciept notice date or will the cases be treated at same level.
