Hi
My I-140 was sent on July, 28th to TSC. I did not yet receive any receipt number. How long does it take to get the receipt number once I-140 is applied?
I received my Receipt in 6 Days. Applied on 21th June and Receipt on 27th June. But still in process at Nebraska Service Center.

Can't avoid anything that future hold for you.
1. It would be good if the employer does not let USCIS know about your layoff.
2. don't apply for unemployment benifits even if you are given one (at least for 180 days from I-140 approval).
3. Hoping your employer does not revoke your I-140
4. Take a 3 months unpaid vacation at the same job and/or offer help by working from home. Accept a lower salary for 180 days.

Can I work for a couple of days using tax form 1099 while on H1B? The amount for the number of hours while working will be less than $600. Please help.
No 1099 needs to be filed by the entity writing the check, if the amount is less than $600. Declare it as "Other Income" (probably with a Schedule "C", please check) on your tax return. Check IRS.GOV and www.investsafe.com/language.html

My wife and I both work for the same company and my PD date is 1 year behind my wifes. But she was born in Germany though she is currently an Indian citizen. Now that the ROW category has moved passed her PD's date (Nov 6th 2002), we plan to file under the ROW category using the Cross Chargability rules. Does anybody have any experience filing under this rule? We have her birth certificate (translated into English from German etc) and our lawyers will send us the list of documents i expect. So basically i am trying to find out what to expect when filing under this category. Are there any caveats, good to knows etc?

My colleague went to India for 6 months after getting his GC, and has been just chilling out here for more than a year now.
You are a free bird once you have GC, just shouldn't be out of the country for more than 180 days in a year for tax purposes..

Hi JSaradhi,
When you got your renewal for your H1b till 2008, you should have also received a new I-94 card with a new validity on it, probably till 2008. I know this because I also recently got my H1b renewed.
Check with your employer. They should have handed over the new I-94 to you.

Today I received email from my lawyer that my Perm was approved yesterday.
Here are the details:
Started preparing for Perm Late June Early July
Advertised on DOL website October 1st - Nov 30th
Paper Advertisements: October - November
Applied Perm Dec 13th
Approval received Dec 27th.

In september my dates became current and my GC and my spouse GC has been approved . However my lawyer recieved interview notices for me and my wife. What should be the next step. Ignore the notices as we recieved the Green card or do we need to attend the interview.
My advice "do not ignore it". Best is to take an infopass and get it resolved. Else attend the interview. Take a local lawyer if you need and tell the officer that you already have a GC. It is better to personally close this issue than reklessly abandon it hoping that it will close by itself. It can create more mess than you can handle.

Hi there,
One of my friend who just finished his masters and in process of getting his OPT in hand, also he is planning to file his H1B visa in 2010.
While his status in OPT he got an oppertunity to own a corporation, my questions to you all as follows.....
1. Can he own a coroporation while his status on OPT? I know one can own a corporation if his/her status is on H1B.
2. If he own corporation with his current status (OPT) and if he files his H1B in year 2010; what issue might he face?
3. Are there any legal obligations to own a corporation while his status on OPT? Or does he require to take any extra measures / precautions to own this coporation?
Note: He just wants own this company and not plan to do anything much to it until he settles down and he wanted utilize this oppertunity.

I have my 140 approved and my wife is on F1. How can I proceed with filing 485? (since the dates are current). I am thinking that my wife need to be on H4 before I file for 485.
