Dear Lawyer,
I had filed I 485 in EB3 category in July 2007 and my priority date is November 2006. I want to start the process under EB2 category also. My organization is very big and will not bend any rules to accomodate anything. There is a job posted in my organization with the following requirements -
Required Qualifications
A Bachelor's degree or equivalent training in Business Administration, Health Service Administration, Mathematics, Project Management or Industrial Engineering.
Five or more years of progressive experience in an exempt-level business analyst, project management or process improvement role.
My question to you is whether this job requirement classify this job in EB 2 category? Thanks.

IV Core - any thoughts on if we should bring this up in DC rally?
Diversity Lottery ends in FY08. As a baby step, to offset this why dont we ask these numbers - 50,000 to be added to EB visa quota?
I'm sure most senators will be agreeable to this - getting 50K immigrants with skills(in the future) vs 50K immigrants only
Where did you hear that DV is ending in 2008? See the newest travel.state.gov. They say DV 2009 starts in October.

You should move this to the Immigrant Visa forum for more responses.
You should notify CIS that you have changed address and ask that the interview be rescheduled. Hopefully you filed the AR-11, change of address forms, with CIS when you moved

is that true? can anybody confirm it.
My PD is Aug 2005, I40 Approved and 485 was filed in Set 2005.
Thanks

All too often, it seems that some examiners at USCIS Service Centers are just looking for a way to deny petitions. Long-standing policies are ignored and new theories are advanced to deny perfectly-qualified applicants for immigration benefits. A few months ago, a few examiners decided on their own that M.B.B.S. degrees which are issued to physicians from British Commonwealth countries were not equivalent to M.D. degrees issued by medical schools in the U.S. As a result, many petitions and applications were denied on this basis. After much protest from the medical community, the USCIS in Washington got involved, and the...

The antis regularly trumpet the argument that we need to slash visa numbers to protect jobs for Americans looking for work. But if employers are seeking to slash payrolls and immigrants were a source for cheap labor, shouldn't we see visa applications increasing? The numbers tell a stark story - visa applications in key categories are plummeting. Eighteen months ago, H-1B applications for university educated workers were in such high demand that nearly 200,000 applications were received on the first day the annual allotment opened up. This past April, only 40,000 applications for the basic H-1B quota were received and...

hi everybody,
hope I will get guidance..Here is my case....
I am an Indian and I have been living in USA for about one year as a dependent of F1 visa holder.Recently I got my I-20 and now I want to change my status from F2 to F1.I have only 2 months left to start my classes. And I have some Questions regarding changing status...
1.Is 2 months period is sufficient if I file from USA?
2. what are the chances of changing status (from F2 to F1) if I file from India?
In case, my visa status does not change, will I be able to come back to USA on F2 ? will they reject my current F2 visa as well?
please.. help me with these questions.I will appreciate if somebody could advise me...

There is no such thing as AP Renewal, it is always a fresh application. That is the reason application does not mention anything about renewal.

Hi,
I have applied for a duplicate passport 4 weeks back because my passport was damaged. I am trying to call consulate office for the status. But they said that they do not provide any status inquiry. I urgently need passport as i have to go back to india ASAP. is there any way to know the current status and speed up the delivery of duplicate passport? Normally how long it takes to get a duplicate passport.
Please help me, I will highly appreciate your help.
Thanks,
Sambhaji

I am nearing the five years on my H1B. My company (A) had it extended with my I-i40 approval. I want to know at this point is it okay to transfer h1B visa to another company (B)? I was told i can only get 9 month extensions with the transfer is that true? Also what if my company (A) cancels my GC process after transferring to company (B), do i have to go through the entire GC process again once I transfer to company (B)? I was told i only have to re apply the I-140 with the priority date given on the previous I-140?
With great appreciation!

I sent my EAD application on 10/24(Wednesday), reached NSC on 10/26(Friday), Notice date 10/29(Monday), Check cashed 10/30(Tuesday)..Already got I-485 receipts back in August.
So they are Current now.... But what about those July/Aug filers who are still waiting for their receipts? Very unfair to them. I could wait for 2 months to get my EAD receipt if they could first receipt all july august filers...
They are really unpredictable..

Some paras from Information, Please (http://www.washingtonpost.com/wp-dyn/content/article/2007/02/18/AR2007021801064.html): Watchdog Groups, Some Lawmakers Say Congressional Reports Should Be Made Public.
Elizabeth Williamson (http://projects.washingtonpost.com/staff/email/elizabeth+williamson/), Washington Post Staff Writer.
Deep inside the Library of Congress, 500 researchers pound out the secret intelligence Congress uses to make law.
Legislators request 6,000 Congressional Research Service reports a year, on weapons systems and farm subsidies, prescription prices and energy use. Together, they offer what lobbyists and industry want most: clues to what's next on the Hill.
For years, open-government groups have fought to make the reports public, and for years, many lawmakers have kept them under wraps. Or so they thought.
By insisting on secrecy, Congress instead created a bootleg market for the research. Every day, a small Texas company compiles the reports and sells them to lobbyists, lawyers and others who pay thousands of dollars for a peek at the reports and what they say about the congressional agenda. And it's all legal.
"How I get them is my trade secret . . . but I get them all," said Walt Seager, who digs up the reports for Gallery Watch, a legislative tracking service.
The Congressional Research Service (CRS) was established in 1914 as Congress's supplier of nonpartisan research and analysis. Its reports are neither classified nor copyrighted, but they've long been the exclusive property of lawmakers, who distribute them as they see fit. Taxpayers supply the agency's $100 million annual budget, inspiring open-government groups and some lawmakers, including Sens. John McCain (R-Ariz.) and Patrick J. Leahy (D-Vt.) to push for public release of CRS reports.
Aftergood and others have fought back by posting every CRS report they can find on their Web sites. But watchdog groups have released only about 10 percent of the total, not enough to reveal the patterns that suggest what Congress might do next.
Subscribers to Gallery Watch pay about $4,000 a year to get all the CRS reports, online and searchable, delivered weekly.
At a recent meeting for potential customers, Riendeau explained that clients scan the reports for intelligence "kind of how the CIA operates," by spotting the political trends suggested by their contents and timing, he said. About a year ago, lawmakers made a flurry of requests for CRS reports related to North Korean counterfeiting of U.S. currency; not until months later, when the Treasury Department cracked down on North Korea, did the issue appear in newspapers.

I heard you can file Perm only if you are on H1 or other status and not on EAD (AOS Pending I485).
That is not true....
You certainly can file new PERM while on EAD. So go ahead and do EB3-EB2 porting...
Good Luck
