Sir/Mam,
I am was in US on H4. I am currently in my home country for vacation.
While here, I got my H1B applied and approved as consular processing for 2011 cap.
I plan to go back to US in August on H4 and then apply COS in October and start working.
My question is : Since my H1 was approved while I was out of US, will my COS also be approved as consular processing only? Do I have to go for stamping again before I could start working???
Also, if I decide to wait and get my H1 stamped in my home country, what is the earliest I can go to stamping for 2011 cap? Can I land in US on H1B sometime mid September and start working from October.

Does anyone know whats going at Mumbai Consulate ? They generally publish the list of Consular Processing (CP) Interviews by 15th and this time no news. Delhi and Chennai have come up with their lists.

The primary can keep working on H1. If you don't plan on changing your job, be on H1. If there is any issue with your application, then you are still on H1. If you are on EAD and your application is denied, then your EAD also becomes invalid.

H1b extension will be for rest of the period, in your case 1year + 8 months.

I need an advice.
I was in US since Apr 1999. FIled for GC in oct 2000. I got my I-140 approved.But then i had to go back to india as my company transferred me to india office in Oct 2001.
I left that company in jan 2004 and joined another company in india. Then in July 2004 i came back to US thru a consulting firm. An din jan 2005 my client offered a job. So since Jan 2005 i am working at the cients office as their employee. I filed for LC in Sep 2005, it got approved in oct 2005 (Just mised by 3 weeks)
My question is was was it possible to use the PD from my previous GC. which is Oct 2000.My atternoy told me it is not possible. But i saw similer posting on IV, hence i am curious. Also if possible is there any way i can get the old GC at this stage,my I-140 is approved this time too.,

I see that India got around 27400 Gcs. Does it mean spill over was happening during FY 2007? I was under the impression it started since FY 2008.

I have a question about forming an LLC while being on H1B. I am entering into an agreement with an Incorporated company to provide my technical services to it and in return they need to give me a percentage of the revenue. Clearly, I cannot enter into this kind of arrangement as myself as I not authorized to work in the US. For that I am planning to form an LLC or an Incorporation and my company will enter into a contract with the other Incorporation. Is this legal or will this be construed as an effort to bypass H1B laws? I'll still be doing the daytime job and fulfilling my obligations that I have with the H1B sponsoring employer.
Please let me know your opinion.

Folks,
I am on my 6th year of H1B. My current H1 expires mid August 2009.
My PERM was filed in May 2008 and was approved in Dec 2008.
My I-140 is applied and pending. I work for an american consulting company.
Naturally, I dont have an EAD as yet.
Based on my PERM approval and 365 day rule, I know I can extend my current H1 for 1 year.
(planning to do this ASAP).
Here is my question:
- My current client contract will get terminated soon. If my current GC sponsoring company decides to terminate my employment (due to project non-availability), can i transfer my extended H1B to another employer?
In other words, is an extension H1 (7th year and beyond) similar to regular H1 (first 6 years) in regards to invoke the "transfer" rule between eligible employers? or is it tied to GC sponsoring employer?
- By doing so, do I abandon my GC application (i think i will, but general clarification) ?
Any advise would be greatly appreciated,

It is sad, and we should do what we can to help those less fortunate than us. Again, period. No ifs and buts about it. But is this the right forum, or even the right website?
There is plenty of clutter on these forums.. (And frustratingly, it has spiked a lot in the last week or so). Please do not add to it.

I am an Indian and I have been living in USA for about one year as a dependent of F1 visa holder.Recently I got my I-20 and now I want to change my status from F2 to F1.I have only 2 months left to start my classes.And I have some Questions regarding changing status...
1.Is 2 months period is sufficient if I file from USA?
2. what are the chances of changing status (from F2 to F1) if I file from India?
In case, my visa status does not change,will I be able to come back to USA on F2 ? will they reject my current F2 visa as well?

Hi,
I want to go outside of US and return back on December 8, 2010 while my passport expires on June 6, 2011. I will be entering on an advance parole document obtained as an I-485 applicant. As such at point of entry my passport will be expiring in less than 6 months (5 months 28 days). Please let me know if the passport needs to be valid for 6 months at the time of entry or this restriction does not apply to entry based on parole.
