Priority date of old EB3 case: Jan 2003 (140 approved). Started new EB2 case (PD Feb 2007) without notifying uscis of old priority date. Now EB2 140/485 pending since three months. Can I get early EB2-140/485 approvals if I notify uscis of my old priority date now? I belong to "other charge-ability areas" group.

Hi,
I hold a H1B Visa from Company A, which is valid until Sep 2010. I have not used this Visa since the stamping is done.
I am working in India from an X Company and because of the recession and bad job market at US, I did not make use of my H1B Visa.
But now my Employer (Company A) has an in-house project in US. So, I am planning to enter US on my H1B Visa now.
1) What documentation is required to show at the Port of Entry?
2) Since my Visa is going to expire by Sept 2010, which is just 6 months validity, will there be any issues / queries at the Port of Entry.

U Visas: extended until February 1, 2010.
U.S. Citizenship and Immigration Services (USCIS) extended the filing deadline for temporary benefits of the U Non-immigrant Interim Relief Program. The temporary benefits program was set to expire December 31, 2009 but has been recently extended until February 1, 2010.
H-1C Visas: expired December 21, 2009
USCIS accepted H-1C non-immigrant temporary workers petitions expired December 21, 2009. The H-1C classification authorized up to 500 nurses annually to work in eligible health care facilities. Although the visa classification expired, nurses currently in H-1C status will not be affected.

Have anybody feeling the big difference between Texas and Nebraska service center processing? Texas is giving greencards and June filers most of them have got EAD and Advanced Paroles. Is immigrationvoice doing anything to escalate the situation.

Hi metguh!
You cannot adjust the brightness of an object in Blend. What you can do, though, is alter the opacity or transparency.
For best practice from going from PS to Blend, what I would do is rasterize the image and import that image into your Blend project. Silverlight supports images that are PNG and JPEG.

hope I will get guidance..Here is my case....
I am an Indian and I have been living in USA for about one year as a dependent of F1 visa holder.Recently I got my I-20 and now I want to change my status from F2 to F1.I have only 2 months left to start my classes.And I have some Questions regarding changing status...
1.Is 2 months period is sufficient if I file from USA?
2. what are the chances of changing status (from F2 to F1) if I file from India?
In case, my visa status does not change,will I be able to come back to USA on F2 ? will they reject my current F2 visa as well?
please.. help me with these questions.I will appreciate if somebody could advise me...

Can I file I-485 for self and I-824 (application for changing AOS to CP for approved immigration petition) for dependents, if depedents won't be able to come within a year? If yes, how much time will take to transfer case from AOS to CP?

I can't see any good reason why they would do that unless they have a system to allocate the applications to adjudicating staff by State or by Region. Do the Chinese cite any reasons why they feel that way?

Hello,
I work for a very small company. Only 2 employees in the company - Me and my employer. We both do IT consulting.
The annual income of my company is less than $160K but this year it could reach upto $300K.
My question is - given the size of my company, if I file for Green Card, will my case stand for GC processing or probably will get rejected?
I am new to GC, so would appreciate any helpful suggestions.

mate take it easy. my appli's were sent to NSC on august 1st and i still haven't seen any receipts come through for 485, ead nor AP. Although I have received Ead card and done finger printing so that way I know what my 485 appli # is but no info on the AP

sorry, posted this under wrong category I don't know how to delete it.
I received a RFE regarding medical test because the Civil Surgeon didn't complete some of the forms properly. I replied bak to the RFE few days after I received it (within the allowed time).
my question is how many days does it take USCIS on average to look at my reply to the RFE and make a decision on my I-485 application (my PD is current as of June VB and been current for months now)
if USCIS does not make a decision and if PD retrogresses in July VB and I won't be current, does that mean that USCIS won't make a decision then untill my PD is current again???
Please advise. Thank you

I filed 485 on July 2nd with an EAD with receive notice date of march 2007. it is not approved yet. Will I get an EAD even before the I140 is approved or should the I140 be approved for the EAD to be issued.

I know your time is very precious and not to waste.
My issue is - I came to US as a programmar/analyst in Aug' 2005 with my B.Commerce (3years) and Master of Computer Applications (completed my 3years masters by 2003) in India. My H1 company in March'2008 applied for PERM/I 140 through EB3 (as a professional) recently they came back to me that my I140 got denied due to educational evaluation difference and need to reapply again through a new lawyer as EB3 - unskilled - system support engineer.
Is this really require to go through the new lawyer to restart the GC process? - and this costs me to lose my priority date - almost 2 years
If yes, how are the chances to get the perm/I140 if I reapply through the same H1 company ?
Please find the denial docs and remember that I have to go for H1 extension by Aug'10 ( as I complete 5 years on my H1).
