By fair trade, I meant service oriented countries like India rely on exporting services (software, cust support, legal etc) and such people movement fees creates trade barrier.
I also see folks are beating up on Infosys for treatment of their employees. Many of you would be forgetting the choices you had as job seeker before these companies came around. IT companies are one of the reasons for rise of middle class in India

Can't we get an ATV from India on Advance Parole. I am assuming that they treat AP as a Visa to USA. Also, can someone confirm that I will NOT need an ATV when going from here to India. I know that under the requirements, they state that Indian passport holders do not need ATV if they are going to India, but did anyone have any experience of AP or transit visa being checked when going to India from USA.

I feel that this is idea of USCIS for this action.
There are so many 485s pending and ready for approval. The composition of PDs of these 485s vary from 2001 to 2006. These 485s belongs mainly fom applicants from India and China, not many ROW. The number of visas available is far more than already pending 485s. Unless they make it to 2006, the visas will get wasted. Even if they recive new 485s with old PD, it can not be approved before sep 2007.
Therefore, now, they are forced to make all catagory current, so that all the 485s that were filed already and pending for long time get cleared. Also, If they make all catagory current, they will recvie all the 485s even with very new PD 2007. Then they can do home work, to estimate the demand in each catagory, accordingly they can retrogress the date in September for FY 2008.
Therefore it is a win-win situation for all. By doing so, USCIS has helped to meet one of the IV objective, filing 485 w/o visas number.

I am still willing to become monthly contributor, in fact in the early days I was a monthly contributor. But can't justify it to myself when only 2-3 % of the community is contributing monthly and willing to help themselves. If after repeated requests of monthly contributions this is the situation, then there is something missing I feel.
I feel if IV brings down the contribution to $10/month, the volume of contributing members might increase and there will be more number of commited members. This is just my thinking.
Not sure why just $25/month to help ourself is such a big issues for so called highly skilled. Maybe its just me, but it feels like people can come-up with thousands of reasons for getting everything for free.

Took an Infopass and visited the local office here in San Diego. Though they were nice and polite...a emergency AP can only be issued if some family member is seriously sick and there need's to a doctor's note to that effect. However, he was willing to raise a SR on the case and added a note on the urgency of the AP and if it can be expedited....not sure if that will do any good. Just waiting and hoping for the best.

Once I selected that, it takes me to the next page that has 4 options.

4. Case Services follow-up appointment
Looking at the options, I would imagine option - 4 looks more relevant ...But it also says the following.
"If it has been over 45 days since you contacted NCSC and have not received a response to your inquiry. You must bring the Service Request ID Number related to your inquiry to the appointment."
I have two questions.

I havent gone through all the threads but I think I am winner by long shot. Here is my story
1991: Came to US as Undergraduate student.
1996: Graduated with Bachelors degree. Yes took 5 yrs as I was working and paying my way with international fees.
1998: Graduated with Masters in Dec 1998.
1999: Started Job in 1999 on OPT. Company applied H1 later that year.
2001: Company sponsored for Labor under EB3. Company policy was 2 yrs employment before sponsorship. All costs paid by company. PD is August 2001.
2002/2003/2004/2005 : Ping Pong between Texas Workforce comission and DOL- Dallas. No updates whatsoever. File stagnant somewhere.
October 2005: LC finally approved by DOL. Filed I 140. Also landed as Canadian PR in 2005.
January 2006: I 140 Approved. Waiting for PD to become current to file I 485. Watching visa bulltein every month for 18 months getting depressed each month.
June 2007 : Finally able to file I 485. Filed on 6/15/07 before July debacle where ppl with 2007 PD could also apply. Talk about Justice buddy :)
2008 : Waited with anticipation as my PD was current for 3-4 months. No good news.
September 2008: Still waiting with anticipation on PD being current and even more imp USCIS actually looking at the file.
Yes meanwhile I am on 9th yr of H1 and 3rd H1 stamping. I have worked all 9 yrs in the same american company and have been promoted 3 levels over where I started. Yes it still pains and yes it is unfair. Well life goes on.
The part that sucks is everything is so arbitary. Even if the wait was 20 yrs but it was purely FIFO it would be ok but hey who said life was fasir. If it were I would be born a Scheduled caste person and be IAS officer in my native India :)

The officer who stamps your passport at POE is supposed to write doen his/her Badge number on the Entry Stamp that they place on your passport. Look it up.
That badge number should be good enough to make a complaint. Also, it is not difficult to track down who the officer was, if you remember the time and date of your arrival at the airport.
You can definitely complain about the officer, because it is his job to ony issue you an I-94 after verifying, to his/her staisfaction the credential and information presented by you. He is not supposed to comment on the labor market. I say get hold of good attorney and sue his (Offer) ass.
This is the sort of attitude that we Indians need to have and show. Otherwise we will always be known as the shaky-confused-getyourasskickedaround sorry lot.

ask for everything in skil bill, anyhow they will try to amend (cut it down) few clauses, so why asking less, it is better to have all clauses. atleast we will have some room to negogiate....

In central NJ, I called over 9 Doctors and only two of them had an appointment before July 1st -2nd week.
One is Dr. Neil M.S. Estrella in Clark, NJ. Appointment was available for Monday June 18th. But the fees for the exam plus vaccines is $430. The second one is Dr. Marcel Stern in Piscataway, NJ 08854. Appoitnment was available for Thursday June 21st. The fees was more reasonable at $350.
If you're in Central NJ, Hurry, Hurry Hurry.
P.S - If some of you get other appoitnments in NJ, post here so that others will know and not waste time calling other doctors.

spicy guy, which service center did you apply? if its texas, you are cool, u should get ur AP within 15-30 days max. I have travel in the third week of november and I applied for renewal in Nebraska and my RD for this is August 6th. I am not very optimistic. Cos, per the website, its taking anywhere between 95-150 days these days for AP renewal in NE.

Agree with the underfunded and overloaded part. But tell me, how come EB2 India became unavailable and then available again? I fear that USCIS is not at all fair when it comes to moving dates. If dates are moved, they will have to deal with so many new applications from ppl whose PDs became current. That may be the only reason to not move dates. In the last bulletin, they did not say anything about high demand for EB2 India, and now they do. Setting up of the cut-off dates is done entirely on the basis of a "forecast" which can be very subjective.
Maybe it's just my frustration today, and USCIS is not being unfair....
Here's how I understand the unavailable versus available part. The years quota is released evenly through quarters and unavailability happens in the last quarter of the year when a particular country has taken up its 7% for that category. I would assume the USCIS also divides the quarterly quota so that the backlogged countries take up 7% each of that quota. Of course they don't say "unavailable" until the last quarter as technically until they reach that quarter there are numbers left for those countries.
This is a layman explanation which may be utterly wrong and I defer to the experts....
Maybe it's just my frustration today, and USCIS is not being unfair....
