Can some one advise me which data is correct? whether the correct data is FOIA or USCIS website data?
If USCIS website data is correct, then the EB-2 cutoff date can not be 01/22/2005 and it should be much more earlier
Hello,
Looking at the Visa Bulletins, I would say that USCIS data appears to be more accurate. I think USCIS provided IV with data that is somehow misinterpreted.

All,
Now I am confused completely. Do we need a transit visa to travel to India or when we are coming back from India. This question is asked irrespective of the new rule (if it is changed or not)

For a moment forget about us and our cause. How do they justify doing this when there is so much of the peoples business left. Even budget bills are left pending.
This retiring congress is truly defining itself as the DO NOTHING CONGRESS and ought to be ashamed of themselves.
The people spoke and still they did not hear the message.

Good to see us gaining some slow but steady momentum...So far we have these users that have agreed to help us in this effort.
myself, indianabacklog, thomachan72, rego, yvjoshi100, legal_alien_007, sri1309, Pandi, Openarms, domainguru, rameshvaid, teachamerica07.
The other users have given positive feedback but have not directly mentioned that they will participate yet.
As someone pointed out earlier, most people here on IV may not know about 'aging out' and the plight of families and children stuck in this situation. And if they do, they do not have direction to help you. It is plain ignorance and not unwillingness to help.
I would follow recommendations by pappu to make concrete efforts, in addition I suggest -
1) Call your cause 'WHAT ABOUT US, DREAM Act?' Type a brief background of what aged out means and how if affects LEGAL families. Brief written and YouTube stories of all aged out children and the hardships they are facing.
2) Request IV to make this a sticky so that it is on the front page of the forums and does not get pushed down.
3) List your plans and how IV members can help reach your goal.
Only a multi-pronged strategy with a single focus can achieve this result. Do not be disheartened that there only a minorty of people in your situation. I am sure once people understand the extreme hardships like 'rameshvaid' sending kids over to Canada, losing 2 years of education and discrimination by the proposed DREAM act, this issue will gain momentum.
This is not the time to be anonymous sufferers, this may be your one shot to get the language in the Dream act. Open a blog on IV, sell T-shirts or whatever it takes to get more publicity. This is America - you get noticed if you stand out and catch media attention to jolt people into action. Try to get your story to some reporters and tie it to the DREAM act.
I will help in any way I can.

Members who have already done both and members who are in process of doing the same should not feel bad about my post. There is nothing that I have said would hurt their feelings.
By the way there are some members who have said that there are few people who are camera shy. It is understandable. Guess what so far very few people have posted their video. You will be able to count on your fingures.
We have 20k+ members. We hope 20,000 (plus) - 20 = 19,980+ members are not camera shy.
There are around 1500+ members on the forum at this time out of 20k+ members. All our members are willing to spent time posting messages and speculating what will happen in next VB. But they don't have time to post their video. The members don't have time to send Thank You Cards. Four people deserves thank you card and members don't have manners to send a thank you note. This is unacceptable behaviour and please change your attitude.
Don't blame Immigration Voice if you see a bill with no amendments for us. Sometimes we have worked like a mad dog taking lot of risk. We are requesting you to post your video and sent thank you card to 4 people.
Please let IV core know if we are asking too much from you.
Thanks

While filing for I 485, I was wondering if I can file for my wife's EAD and AP and dont apply for mine (at this time) as I am not going to change the job in next few months. So I will keep working on my H1 (valid till 2009) and she can work on her EAD? Is it possible and legal to do ?
Thanks,
You can apply for your spouse's EAD and AP and not for you. This is up to you.

Another help from your favorite administration in screwing your life.. Obama clearly wants to reduce the influence of indian community but our people are idiots....
Well, I would not go out that far to think he is against Indian community - he may just be against EB immigrants. The Dems sure do want to put Family based immigration ahead of EB immigration and they won't hesitate to use us as sacrificial goats to get FB immigration the advantage.

I did not come by my own. The company I was working in India had sent me here. I will go back to India if I need to( personally or officially).
senthil1,
So you are saying that "before" you came to US there were not much fake resumes. But after you arrived, number of fake resumes have increased. The only qualifier that highlights the change between the two situations is your coming to US, isn't it? My question to you is, why are creating all these fake resumes? Why did you come and why don't you go back? Maybe that will stop all these fake resumes and rest of us all will be back to our good old days.

If you apply for EAD and AP, you can't travel till you get AP.
If you apply for EAD, you can get H1B stamped and travel on that.
I think you are safe after getting receipt notice if you are in valid H1b status. But make sure do not apply EAD. If you apply EAD you need to get advance parol for travelling.

What else do you expect on a site operated by a FAIR veteran ? If you didn't know, Dan Stein has been the director of FAIR for a long time. What is interesting though is that of late, there has been a visible dissenting opinion by H1-B posters.
A lot of the views expressed in this thread are those of people that support FAIR and numbersusa. Sad!

Hi:

My Hr got the cover letter showing my labor approved by email from dallas BPC. My lawyer does not seem to have received the whole package yet(no idea why lawyer don;t get the packages on time). I have no clue.
But my HR asked Dallas BPC officer and she said that cover letter was enough to file for I140and plus I485(concurrent)
The cover letter is part of the whole approval package.

Is it true...Please confirm.

So it is back to square one with SKIL bill too? Hmmmm this is annoying.
yes, to the best of my knowledge, bills that have not passed, die with the current congress. everything starts again, come january.

Here are the dates:
CIR 2007 introduced in Senate on: May 9, 2007
CIR Vote on cloture fails in Senate: June 7 2007
A related bill S. 1639 fails on: June 28, 2007
Comprehensive Immigration Reform Act of 2007 - Wikipedia, the free encyclopedia (http://en.wikipedia.org/wiki/Comprehensive_Immigration_Reform_Act_of_2007)
July 2007 visa bullettin released on :June 12 2007.
Bulletin was reversed on :July 2, 2007
S. 1639 failed on June 28, visa bulletin was reversed on July 2
July visa bulletin had already come out on June 12 2007.
The decision to publish this bulletin might have been taken sometime in May 2007.
Even if we base the events on the Original CIR 2007 which failed on June 7 2007, it would have taken sometime to communicate the decision to revert the bulletin to USCIS.
May be you are right or may be it is just a theory...who knows....the bottom line is that it does not matter who is at the helm (republican or democrat), nothing good has come to EB applicants since 2000 and it is going down hill. A lot of things have played a factor eg. 9/11/2001, 2001 recession, Bush's CIR idea in 2004 to give amesty to undocs which polarized both sides and we got caught in the cross fire, anti immigrants, racists (steve king, lou dobbs, tancredo, grassley and likes), protectionists (dick durbin, bernie sanders), no unity among EB applicants, 2008 recession and the list goes on.
CIR is such a lightning rod that even this administration (especially Rahm Emanuel) whose party has super majority in the senate, does not want to touch it. Any time we ask for a just a visa recapture, they say it will be a part of CIR which means that it is a dead-end deal. Now, to top all this, they are thowing more books at us to make us all illegal and find loop holes in the law to deport us. Man, I give up.

I had another BAD experience while stamping. VFS emailed me that my 2 kids ( 4 months and 3 years ) kids cannot enter consulate while me and my wife go for h1b / h4. and main thing is they are US citizen .. I replied that and still got same answer. BUT on day of interview we kept our kids with us and we were given 1 st priority in line. Even when VO asked about kids immigration status and their status next thing was UR VISA HAS BEEN GRANTED. I complained against VFS and got call back from consulate within 24 hrs and they promised to take action against person who relied that US citizen cannot enter consulate.
we must speak up .
Get it fixed. Like someone suggested, go to the airport immigration department and tell that the officer put in a wrong date. Ask for help. Get letter from employer, Attorney etc...

Hi Guys,
My case is filed from Denver (Colorado) under Non-RIR/EB2 in October 2001. I haven't heard anything about 45days letter or anything else.
Pleople who applied from our company (Non-RIR/EB2) arond April 2002 or after got 45 dyas letters. It is very inconsistent.
Keep posting as you get information.
