The New York Times recently ran a profile piece on radio show host Filemon Lopez who broadcasts in native languages from a station in Fresno, California to poor Mixtec Indians from Mexico working in agriculture in central California. Lopez, a beneficiary of the 1986 legalization program, has been in the US for 30 years. He brings a little piece of home to immigrants performing backbreaking work to put food on our tables.

My situation is tricky here. I would really appreciate any inputs.
My six years validity for H-1 B will be complete in Mid Dec 2007. I filed my Labor on March 5th in Atlanta. As you know the ATLANTA center is really really slow and I am still waiting on my Labor approval decision. I thought of applying 140 through Premium Processing. Now USCIS suspended premium processing for 140s. My question is:
Whay will be my situation if my Labor gets approved and 140 is pending as of dec 2007 as the LC is filed with less than 365 days remaining on H1 validity? Will I be out of status or can I apply for 7th year extension.
Please guide me through the process and any scenarios. Thank you in advance.

Hello Attorneys,
My company recently moved offices to a new location just a few miles from the old location. Its in an adjacent county but with in the same state. We moved from Northbrook, IL to Deerfield IL, does this warrant a change in LCA/H1B?
Please advise.

Most attorneys have historically advised to file ammendment to LCA in case of address change like this. Provided that job conditions same, (which is likely in your case as it is just a few miles away) ammendment should be easy.

My current H1 expired on 7/9, I applied h1 extension (with approved I140) on 6/30/10 with client letter (with no end date) and other documents. I got approval last week, they approved my petition from 11/18/2010 - 11/17/2011. 10th year extension.
1. What is my status between 7/10/10 - 11/17/2010?.
2. Do i need to inform USCIS?
3. I expected 3 years, but I got only one year.
Is anybody faced similar situation or any suggestion.

Some sections that are not in dispute, such as the provisions on day laborers, will take effect on the scheduled date. seems to say that as long as you have a valid visa (which a greencard is a physical manifestation of an immigrant visa) then you should be ok.
Assuming your son is a US Citizen - he won't need one either.

I believe they promise a 15-day (business days, I assume) turnaround on Premium Proc applications. So it could take anywhere between 1 and 15 days, if not longer in certain cases.
Also, why is going to India dependent on receiving on an approval of I-140??

I e-filed my EAD renewal application along with my wife's EAD application on 03/16 and both were approved on 04/07. We both have sequential receipt #s.
However, we received my wife's EAD on 04/12 but not mine. I am the primary application of 485.
Does this happen often ?
I would be concerned if you don't see anything in the mail by end of this week at the latest.

You can transfer your H1 to another company and you will get extension of same validity period (check your I94 Expriry period).
You can retain the priority date of your labour when you file I-140 in the new company.
By the way, why dont you start your I485 process now in the current company? You have lived with them for so long, 6 more months after applying I485, may not be a matter I think.....

Today I had a LUD on my old I-129 (approved in Aug 2005). The online status say: �On August 29, 2007, the post office returned our last written notice on this case as undeliverable. This can have serious effects on the processing of this case. Please call 1-800-375-5283 to update the mailing address so this notice can be re-sent.�
I'm no more working for this employer and I�ve changed to a new employer a year ago. What does this status mean?Any ideas?
Does this cause any problem to my current GC process which was sponsored by current employer?

My sister is in US in Visitor Visa with I-94 expiration date of Nov 25th 2009. We would like to convert her status from B2 to F1 Visa ASAP.
1) Do you know anyone who has changed the status from B2 and F1? If yes, can you share the experience?
2) Is it risky to do that? What kinds of problem we may encounter?
3) Can she stay in US while F1 is pending? what happens if rejection shows up after her current i-94 expiration date?
4) Is it better to go home country and apply for the F1 Visa or it is safer to change the the status in US.
Any advise you can throw will be appreciated.

In what could be a new incarnation of the successful bipartisan �Gang of 14,� Minority Whip Trent Lott (R-Miss.) hosted a meeting this week with a handful of the Senate�s most notable compromisers to figure out how to unclog the gridlock that has slowed the chamber�s progress this year.
About half a dozen moderate and independent-minded Republicans and at least one Democrat � Sen. Ben Nelson (Neb.) � participated in the Members-only huddle, which was held quietly in Lott�s Capitol office Tuesday morning. Afterward, few Senators offered much detail, but several said there�s a feeling among them that the narrowly divided chamber no longer can operate at an impasse and they want to find ways to avoid the growing number of filibusters sidelining Senate legislation this year.
�We�re seeing if there�s a way to bring some people together to bring some more comity to this place,� Nelson said.
Lott declined to discuss the meeting or its goals, saying only: �I think I ought not say anything. Others are going to say too much, so I am not going to say anything.�
According to other Senators, however, the discussion focused on how the deal-minded group could help avert the growing number of standoffs in trying to clear bills through the Senate this Congress. Most particularly, Senators said they vetted ways to work through upcoming fights on such issues as appropriations bills and stalled judicial nominations such as that of Leslie Southwick, Lott�s home-state pick for the 5th U.S. Circuit Court of Appeals.
Southwick narrowly cleared the Judiciary Committee last summer but has yet to come up for full Senate consideration. The White House and Republican Senators have been trying to corral 60 votes to advance his confirmation, but are still shy of meeting that mark against powerful Democratic opposition.
�It�s about creating a better environment to get things done for the country,� said Sen. Lindsey Graham (R-S.C.), who participated in the meeting. �We need to get back to being a deliberative body.�
�We�re going to see if we can work beyond the logjam,� said Sen. Olympia Snowe (R-Maine), who also was there and described it as the �beginning of a process.�
Graham, Nelson and Snowe were members of the previous Congress� bipartisan Gang of 14, a group of seven Democrats and seven Republicans who assembled in the face of a bitter partisan Senate standoff over movement of President Bush�s judicial nominees. The group brokered a historic deal to allow for votes on certain stalled Bush picks in exchange for keeping the minority�s option to use the filibuster intact.
That group didn�t formally involve Lott as one of its members, but the then-rank-and-file Mississippi Senator was a primary force behind the scenes leading to its creation. Lott stepped away after the gang officially formed.
Nelson wouldn�t say this week whether Tuesday�s meeting was a step toward
re-creating a similar bipartisan coalition, calling the Gang of 14 �unique.� But the Nebraska Democrat did suggest there are clear parallels in terms of the two groups� goals.
�It�s just a conversation at this point,� Nelson said. �We�re trying to see if there�s an interest in building support for moving legislation and to avoid having as many cloture votes as we�ve had and moving legislation along.�
So far this year, the Democratic majority has called to invoke cloture, a lengthy procedural roadblock that has markedly slowed down Senate action on a whole host of bills, some 56 times. Democrats have argued they are forced to do so against an intransigent 49-seat GOP minority, while Republicans have insisted it shows that Democrats are trying to ram through legislation without their input.
Although not all showed up, sources indicated that about 10 Senators were asked to take part in Tuesday�s meeting. In addition to Lott, Nelson, Graham and Snowe, GOP Sens. Susan Collins (Maine), Bob Corker (Tenn.), John Warner (Va.), John McCain (Ariz.), Gordon Smith (Ore.) and Norm Coleman (Minn.) were invitees.

You should be fine. If you I-140 is not approved by 2008, you can apply for a 1 year extension based on the fact you have an approved labor. Otherwise you would get a 3 year extension.
