I sent my EAD application on 10/24(Wednesday), reached NSC on 10/26(Friday), Notice date 10/29(Monday), Check cashed 10/30(Tuesday)..Already got I-485 receipts back in August.
So they are Current now.... But what about those July/Aug filers who are still waiting for their receipts? Very unfair to them. I could wait for 2 months to get my EAD receipt if they could first receipt all july august filers...

You could be in H1 till Dec 2010. Nothing in the law states that your already approved H1 has to be revoked, with the PERM denial.

I had a H1b visa but never travelled to US.My visa got cancelled without prejudice when i left the organization.My new employer filed l1b individual on my behalf.i129 was denied by uscis stating that i am a skilled worker but do not possess specialized knowledge.Moreover the position in US is that of a software engineer & does not require any specialized knowledge.Please note that I hold a Bachelor of Engineering degree(BE) in Electronics & Telecommunications with about 5 years of IT experience.

Yes, your current & past paystubs(Primary H1B holder) are needed to grant H4 Visa for spouse. H4 is a dependent visa and is granted based on the primary H1B visa holder's status. In case of transfer from H1B to H4, his paystubs are also needed to proove that he was in legal status during this time.

The ridiculous amount of time DOL is spending on the Perm Audits in just incomprehensible. They still approved 1 may be 2 application a day, thats my assumption. Last time I saw they are still processing audited-applications filed in Aug/Sept 2007.
Any word on how what their plan is? They really do have bunch inefficient people working for government!!!

The early retirement of US Senator Mel Martinez (R-FL) has opened up an appointment opportunity for Governor Charlie Crist, himself a candidate for Martinez's seat. Crist will likely not appoint himself and a number of names are circulating for potential replacements. According to Politico, one person being considered is Jacksonville-area State Representative Jennifer Carroll. Carroll would be the first black female Republican Senator if she were selected. Carroll is a native of Trinidad and a retired US Navy officer. If her H-4 has not expired she can file now for a change of status from H-4 to H-1, as per the last action rule, her petition filed now will override the earlier request for H-4 extension. If she does not have an unexpired H-4 she can file for COS based on the pending H-4 extension request by including the receipt.

Hi All,
I have H1B stamped from company A which is valid untill Oct 2008. I am planning to go to India in Jan on my new transferred H1B from company B.
Do I have to take an appointment in India for getting my new H1 stamped? Or can i just show my new approved H1B from company B on my port of entry in US, when I come back?
New Approved H1B is enough.You don't need visa stamp again.

All,
Over the past few days we have been successful in getting good media attention BUT except for NYT, the coverage has not focused on the issues that are relevant and will draw the attention of the policymakers. I think the media drive should focus on getting the following issues highlighted:
1. Lapse in protocol when issuing green cards
a) Green cards issued WITHOUT security clearence
b) Green cards issued to those whose PD was NOT current in June
2. Obvious intent to NOT accept applications in July so that they can receive the same with a higher fee in the future. This at the cost of making a mockery of hundreds of thousand of hopeful legal immigrants
I think the media drive should focus and highlight the above and other key issues rather than merely reporting on the sequence of events. Please share your thoughts and add to the list above

Hi,
I got a RFE while doing my H1B transfer under premium processing. They have stated to respond within 60 days. Does anybody have an idea as to whether it takes so long or it gets resolved soon under premium processing? Please help.
Once they recieve the response, if they are satisfied, the same day they will approve. It will not take that long depending on the type of RFE.
