The attorney Rajeev Khanna explains about the interpretation taken by INS/NSC of bachelor degrees which are of not 4 year duration. NSC takes the stance that one cannot combine degrees/diplomas to be equivalent to a 4-or-more-years bachelor degree. NSC argues that a case to be considered as EB2 with BS+5 years exp, that person should and must have a conslidated one bachelor degree of atleast 4 years. But most people who talk about 3 year degree rule are talking about an actual 3 year degree program(like BSc/BA/Bcom) in India. My degree is a 4 year degree but allowed to be completed in 3 years because of our advance standing by virtue of completing the diploma in the same fields of Engineering.
It is a regular BE/BTech program in India (if you are familiar with them)
10+3+3 instead of 10+2+4.

I have an approved i140 as of 01/16/2007 , company got sold on 01/31/2007.
Now pD (may 2003)is current and i have to refile i140 with 485 on june 01 2007,
what will be my i140 date?

I feel my wait of just under 11 years pales off in comparison with some other IV members. Here's my timeline...
1997 - Arrival in US for Masters.
1999 - First H1.
2001 - On H1. First Labor Application EB2/RIR. Labor got remanded and sent back to SWA. Waited 3.5 years to no avail. Left company to pursue better career options.
2005 - On H1. Second Labor Application EB2. This time around it was via PERM. Filed 140 and 485 non-concurrently.
2008 - Still on H1. Got 1st set of EAD and AP last year. Got 2nd set of EADs this year. Still waiting for 2nd set of APs and of-course the 485 approval!
Hopefully, after a few years, we'll all look back upon this spectacle and chuckle! Cheers.

Myself and my family came back to US 2 weeks ago using AP and we did not have any issues in Frankfurt. Officer did check AP documents and stamped the boarding pass. No worries.

Not sure why everybody are so panic about this. Please read the UCSIS recent FAQ. They clearly mentioned at Q15 that there will be delay in processing for backlogged countries. That means..they will accept all applications whether visa# is available or not.

There are so many posting about signs of CIR and now our EB bill taken up in lameducK. (900 companies, farmers, The story of Mr mehta in almost every newspaper on thursday I believe).
The voice of so many illegals and the president's was not considered earlier, how would anything else of CIR be considered in lameduck.Immigration was never and will never be an issue to voters. So talking CIR now will not benefit Republicans in any way in (2008 elections)
We should make EB a separate bill (Reps say it is one bill together), we should pull it away from CIR.
Next year most people think that CIR may pass because democrats favor it too and democrats could say that the Republicans did not do it, we did it and take few more votes in 2008 which may help.

I was working in India in a pretty good company but I was experiencing red tapism, nepotism and all the standard problems of a job culture of India. Here in America, we have only one "Seemingly very horrible" problem of immigration problem. But the good part is, it is common to a lot of people ! So why not to fight for it through a common plateform like this one !
I think that is also one rational solution among others.

Can someone please tell me why I can only see up to Apr-09 in the PD drop-down in my profile settings? Because my PD is Jul-09, I can't select it and hence cannot run these two scripts without getting a stupid mySQL error!!!!!!!!!!!! :eek:

sweet23guyin, they keep a count of those called for and against the bills. Even thought the lawmaker currently supports the # of calls from those against the bill can influence the lawmaker to change the mind. So it is essential to make the calls.

I think Canadian PR would be useful if your destination country is Canada. What is the point in having a Canadian PR and travelling to USA. But again, this is just my assumption.

This is a classic argument from basically two schools of thought.
One school, the "had a great experience" one, argues that not every desi employer does this and that they had a great experience.
The other school, "I knew what the desi company was doing but still decided to do it anyways", argues that the very desi company they worked for, aiding and abetting every action of theirs for the single and sole-purpose of surviving here in the US, obviously a selfish reason, decides to speak out now against "DESI" companies.
Understand that DESI companies offer to take you for a ride. If you step on it, you are now going for a ride. Don't get off after the ride and blame the service. IT WAS YOU WHO DECIDED TO DO WHATEVER YOU HAD TO DO. Instead of blaming the system, help fix the system.
As far as I know, every system/law has a loophole. It is your responsibility to act when you know that a law is broken. If you not, you have essentially aided the entire scenario.
Oh! On a lighter note, I honestly don't give a hoot on if you are from a top school or from a 2-tier or 3-tier university. Please don't underestimate anyone.
