Does anyone, please could help me with the following query?
If my I-140 is not approved yet, is Uscis touching my I-485 application....in other words is I-485 being processed (not approved, only processed)even if I-140 is not approved?( I applied concurrently in August 2007, and my priority date is current, Eb3 ROW).
I would highly appreciate your reply!
Thanks in advance.

first person view? third person?
either way it's kinda complicated, although 3rd person would be easier, for the room would not be moving.

My I-485 case has been transferred from Texas center to Nebraska and notice says it's for faster processing. My priority date is Nov 2003, EB3 category, indian national. I didn't expect they would be looking at my case now. Why would they transfer it? has anyone received any such notice?

Folks,
We received letter from USCIS NSC saying that our AP (incl. my spouse) were approved on 10/15/08. On 11/17/08 we received RFE on my spouse AP application for photos. My wife had already left for India (11/15/08) assuming that our AP was approved. Anyways.
My question - If NSC approves her AP application (again), which date will she have on her approved AP application (i.e will the date be still 10/15/08 OR after the RFE response for photos). Photos were received at the NSC on 11/26/08.
Is anyone in the same situation. Your input is much appreciated.
Thanks.

From time immemorial, the world has been a dangerous place; no less so today. Those with the means and will have have always relocated to less threatening or merely more desirable locales. In todays globalized and interconnected era, the European debt crisis, terrorism, declared and undeclared wars, restrictions on religious and political freedom, and the remarkable rise to world leadership of a bi-racial man with roots in Kenya, Indonesia and Hawaii - all of these developments, and still other enticements, have coalesced to make the United States the worlds premier immigration destination for affluent individuals. The federal government, however, has...

1. I got laid off from company A last year. I was on H1B. Company A notified me about 1 month in advance so I had some time to find another job. I also had a valid EAD which I wasn't using at that time. They also did not cancel I-140.
2. I joined Company B using my EAD within the 30 day period, so I never went out of status. Also, I didn't file AC21
3. My GC application was approved in the first week of Aug.
I have a couple of really interesting opportunities that I would like to pursue. My job profile has been similar at both A and B and will likely be similar even in C should I join there. Am I required to work at B for any specific period of time before I can pursue these opportunities?

Immigration lawmakers try to pick winners and losers. The problem is that just like a broken analog clock with its hands frozen in place, the timing is mostly wrong. This brings me to one of my pet peeves. It bothers me that the immigration laws and agency regulations favor some fields of study and disfavor others. Why for example are students in the STEM subjects(Science, Technology, Engineering and Math) given 27 months of "optional practical training" -- a euphemism for work permission --- while liberal arts students get only 12 months? Do Congress and the immigration agencies think we have...

[COLOR=Navy]1.Does it matter size of new company in terms of money or number employee
No.
2.In case of RFE, Will there be question on Ability to Pay on new small company?
CIS might ask for evidence that the new company is legitimate and financially viable.

The big question is that why the so called "IV leadership" is not filling a FOIA request for how many EB3-I cases pending till date. Infact they should ask numbers for all the categories and their priority dates. It should be simple SQL query for USCIS.
This is such a burning issue and so many people are suffering from it. I still don't get it why would IV is not raising this issue... Can some one from leadership group respond please.......

One reads this story in the Dallas Morning News and is prompted to scratch his or her head wondering how these two women - both here since early childhood, both with completely clean criminal backgrounds, both married to US citizens - could be facing deportation. And how is DHS so tone deaf to the facts? The agency has the discretion to not pursue deportation, yet it chooses to do so. The agency also has the authority to allow these women to pursue their green cards, yet chooses not to do so. And they are silent when the women and their...

I recently joined UF. I have some doubts on working on F1:
Can I work on F1 outside the campus?
How many hours can I work and does it have to be related to the studies I am pursuing?
Thank you for helping me.

In addition, approximately 20,000 U.S. Master's or higher petitions (i.e. advanced degree petitions) have been received. The USCIS is still accepting petitions at this time, but it is advised that any H-1B petitions be filed as soon as possible as the USCIS could announce that the cap is closed at any time.
