What u have stated is factually incorrect. After you get EAD and you have completed 180 days after filing 485, yes you can use AC21. However, your statement that employer cannot harm is wrong. The employer can still withdraw you 140 and then use the labor for someone else or keep the labor. Once 140 is withdrawn, your PD is lot. You don't have a PD. When your 485 comes up for approval, no one seems to know how USCIS will treat your file. Well, if you don't have a PD, unless your category is current, they cannot approve.
Well for India, EB2 and EB3 i am not sure if it will ever be current.

I agree. Life on EAD/AP is just as if you had a green card - except you can not start your own company. But one can keep changing jobs, promotion etc. The con is that one has to apply for EAD/APs each year meticulously. If the employer is paying then even that is a minor irritant.

all this propaganda of indians being good at science and math, and americans not studying science and math, is hogwash.
indians hardly ever get any nobel prizes, or even patents or original journal articles. most science articles from them are "review of .." etc type, which are just a formality to get the numbers into their resume.

americans are not stupid. they don't study math or science, because it does not pay. they study english, MBA etc because that's where you make contacts, and contacts get you places.

As the past experience suggests, the situation will not be clear until USCIS/DOS decides what the law means. It really does not matter much what the lawyers think right now. So we should take the conservative attitude here and lobby Sen. Frist to drop the provision or try to get clearer wording.

Keeping country competitive is an area that bears no logical relationship to border
security. The foreign workers form a very small fraction of the entire US work force.
Isolating and scapegoating them(their employers and inturn the employees) with a national
problem only demonstrates the level of competitiveness (and heroism) of the lawmakers in Washington to tackle a problem, let alone ethics. Congress seems to never have foreign workers in mind, when it comes to working on clearing immigration backlog for these highly ignored set of people. One wonders what makes them remember these workers now ? Or may be is that the way it works - if workers dont keep waiting for decades then how will border security get funded. Given the reputed history of this

1. They had to post the 485 pending list sooner than they anticipated because USCIS "one up"ped them by posting the info on their website and hence they were not able to play "God" with that info anymore.
2. They got my ID and IP banned but still I came back.

I have applied for family based GC above 21 yrs old on December 2006 and also currently holding h1 valid from October 2008. I also have my opt till May. Now since my employer was not able to find me a project he wants me to chg my status. I do not know what to do and how to chg my visa as, if I go on student visa I need to show financial documents and since I have not made any money how is it possible . If you can also suggest some schools who will not charge much or some courses which are not very expensive and time consuming and also where I can get work authorization as I will find jobs which are not technical and in line with my educational and work qualification . I have a deadline this evening as my employer just called me and told me this

Retrogression and delays are driven by quotas and not by prejudices of USCIS employees.
They are there to do their jobs just like everyone else. They dont slow down their work or act with prejudice against any country's immigrants or their cases.
There is a procedure to adjudicate cases and they follow those procedures and even if they want, they cannot just start acting on whim to reject cases. They are underfunded and overloaded and that causes slowness. And the USCIS does try, though not very successfully, to reform the system : Recent example: BiSpecialization etc. Doest always work but their job is to do their job and not set policy.
This is another tactic of numbersusa to find dirt on USCIS and to use that dirt to trash the entire system of immigration. They want to say that since someone killed while driving drunk, we should prohibit all drinking and all driving.
Please dont be scared of concerned with such dirty tactics of numbersusa. It doesnt mean anything.

Please also consider the fact that there are some of us who have to file EAD after we get the 485 receipt. Our lawyers/companies didnt file EAD with 485.

I would be in the same situation but the companies which did not let their employees file EADs in the first place would not be willing to provide the Receipt notices to them. They will instruct their attorneys to hold on to the RNs or and not give even a copy to the employee.
