    Hi,

    My 6th year H1 expires in Feb'07 and company is ready to apply 7th year extension using premium processing. Assuming I get H1 extended by Oct 1st and travel to India in Nov for 2 weeks, is there a problem in coming back with old visa.

    Since the appointments are full for the next 6 months I don't have any realistic chance of getting new stamping done during the trip. I know traveling while extension is pending is a big NO NO but if extension is approved am I allowed to use the old visa stamp?

    Hi All,

    I have an approved I-140 from an employer X. I-140 was approved 2 years ago. And last year I left X company and took a full time position. Since X is my frined he did not mind leaving his company at that time.

    I applied for 485 in July as a future employee for X using that approved I-140. I got EAD and AP also.

    Now we got into some money issues and he wants to revoke my I-140/I485?

    Can he do that?

    Please advice.

    Dear all,

    I have got a employment offer from employer in Mississippi. I am currently in H1B status. When I am looking for filing address, I am confused by the following information on the I-129 instructions sheet:
    Regular Processing
    Except for the classifications listed below, Form I-129 is filed either at the CSC or VSC, depending on the location of the temporary employment.

    Exceptions:
    Additionally, H-1B employers filing petitions which are cap exempt must file at the CSC.

    My question #1, I am cap exempt due to H1b transfer so I should file to CSC but employer location is in Mississippi so I should file VSC as per employer location.

    Please clarify me the filing location.


    My question #2, In sections 2.2 and 2.5 of I-129 form, am I currect If I check e for 2.2 and c for 2.5??

    Folks,

    Forgive me if this sounds rudimentary. It's only recently that i've become aware of the nuances of the whole GC process along with the mind-boggling delays.

    Here are my qstns:
    Is it ok to have 2 concurrent LCs filed from different employers only one of whom i am employed with, (the idea is that the first one that get's approved will be used for the 140 and/or 485 and the other withdrawn)?
    Does it constitute a conflict of interest?
    Or is the conflict only in the I-485 stage?

    Does it cause any complications with LC or I-140?

    Have any of you had to do this?

    Hi all,

    Please let me know what could be the problem. On Apr25, my status changed to Case Received and Pending. Last Updated Date is 05/18.

    When i contacted my employer, he says my petition is approved. But still when i find the status online, it's not reflected.

    What could be the problem?

    Any thoughts would be highly aprpeciated.

    Hi
    I am going to appear for H1-B interview next month.
    I was supposed to get my degree in 2000(Electronic Engineering) however due to backlogs and since I started job before degree completion I completed my degree in 2005.
    Is that a real big problem?
    Although I have double bachelors one in Electrical Engineering and other is science but my work evaluation is based on my bachelor of engineering degree.
    Please help.

    Hello Friends :

    I recd. an email from my attorney this evening stating that "We have mailed you the FOIA request for your and your spouse's signature."

    This doesnt make any sense to me, as to what does FOIA mean to start with. So I emailed them back asking, what does it mean and is it something to do like RFE towards my AOS papers filed on 2nd July,2007 (no checks cashed yet, no info in system yet).

    My Attorney replied back stating that - "We have filed for full copies of your petitions to be sent to us. The FOIA will allow us to obtain a copy to check the integrity of the filing for our records. Looks like, it will be several years before these I-485 petitions are actually reviewed by the Service unless we see a change in the law. ."

    What does this all mean? I am so confused....

    Pls. advise me. Thanks a lot

    Will they send an RFE immediately even after the I-485 has been pending for more that 180 days?

    depends on the officer. A lot of officers do not know the AC21 law. As soon as they see 140 being revoked, they blindly send denial notices for 485 and you have to correct this through MTR.

    After a 140 revocation by ex employer, it takes a few weeks for USCIS to act.

    I know we are pouring our ideas in different threads including one who supports our cause like name/news of senators/rep with grades, companies (employers), univ, associations, news reporters, talk show host, media, etc.

    So I thought of creating this thread just to compile list of one who support the bill (or) one who we can convince our cause to support us, etc. This will definetly help the IV core team.

    I know IV core team is aware of (or working with) most of the supporters, but still each new addition counts to our success.

    for e.g., I read an article few days ago "1986 bill authors make a final push" in IV news article thread (http://www.washingtonpost.com/wp-dyn/content/article/2006/09/14/AR2006091401179.html) which talks about the opinion of "1986 Immigration Reform and Control Act - IRCA, or the Simpson-Mazzoli bill" authors Romano L. Mazzoli (was a Democratic representative from Kentucky) and Alan K. Simpson (was a Republican senator from Wyoming.)

    after reading this, today I thought, might be an idea to contact these former senators, who can voice our genuine legal immigration concerns. Definitely they will have friends in capitol hill on both parties who will listen to them and also people are talking more often about them now than ever. this will help us in great deal. IV core team: please contact these former senators and pitch for the immigration reforms.

    so please come up with the list of people or organisation, etc....whom you can think will help our cause in this thread.
