is this forum all about those that have applied for LC or GC?? What about those that are on H1s but have no hope of applying for GCs? Learning01, as a senior member, please clarify.

I have approved I140 (EB3, PD:Nov'04) from previous employer; after getting my MBA (Jun'06), I have changed the job and my job description has also changed. New employer will file the labor after 3 months (HR Policy)..I have good relations with previous employer, they are ready to file I485. Is it possible to file I485(previous employer), while I am working with new employer?
I am not sure but I came to know (not reliable source), that it is possible to file I485(previous employer) and during the interview, I can submit a support letter from the new employer. is this correct?

As far as I know, I-485 is not the petition for Visa whereas, I-140 is the immigration petition. Your I-485 stems from the underlying I-140. I-485 is merely an adjustment of Staus from non-immigrant to immigrant intent if you are already in this country.
Let's see how this all plays out. After seeing yesterday's amendments, all my anxiety changed into laughter as that's how pathetic this bill is at this point.

vdrao may be right. My I140 was mailed on 1/30/06 and at that time Processing dates were Sep05. I got approval in 3 weeks after filing.I was yet to start counting days as I thought I will get in about 6 months.
So, it is all upto IO handing AOS once visa numbers are current
Processing dates are different from priority dates. It is highly doubtful that anyone w/ PD between 04/04 and 06/06 will get GC approved before Aug 1. But hey...this is USCIS anything can happen right ??? :)

First of all Congratulations to everybody who can apply for I-485.The people at USICS are so smart that for the next 4-5 years people will be renewing their EAD cards.The USICS will be minting money and having a grand party.

Does anyone knows how one could keep the Green Card status active while living in India? Does the person needs to be in US for 6 months out of a year or it could be one visit every year to US ?
You can take a permission from USCIS to remain absent for a period of upto 2 years. After that you will either lose your GC or you need to go back to consulate in your home country and ask for a permission for reentry.

ok can u guys stop giving me red dots....i havent posted on this thread since the 31st of last month. I was hoping it was buried but somehow it came back up.
my reasoning was this. there is no such thing as a free lunch...any rebates we get this year will have to be balanced out in our tax returns for the year 2008. that means higher taxes for people who pay taxes.
but it looks like no body wants to think about that or deal with that..therefor i officially take a step back from my previous position..hope all ur spouses and children and parents and other dependents all get a rebate.
plus i think i got some major bad karma by posting my views on this thread..i ended up with a scratched cornea when i woke up on the 1st. It was one of the most painful experience in my life...so please ...i eat crow...let everyone get rebates...please stop giving me a bad reputation and really offensive comments.

Could you please post one or two talking points specifically for this bill so that members do not confuse it with the other bills out there.
Yes a few important talking points would be useful. My understanding is most of the time calls are taken by someone to note the support of the specific bill number, so calling with bill number and some generic talk may be OK but a targeted talk to point out one or two points by all of us may have more impact.
BTW...I called Delahunt's office. First mentioned HR5882 and used a few generic talking points to request the congressman's support.

If someone does not have a NRE or NRO account, just a simple savings and Checkings account with FD (Called CD's here) ---------- All of this is in GOVT owned Banks, Like SBI, Punjab national bank, Vijaya Bank etc.
Before coming to US the sum of money in all these accounts and FD's (Fixed Deposits) was less than $10K. {Principle + interest}
Now after we came here we funded these accounts with money sent from US (TAX PAID MONEY WAS SENT FROM US BANK ACCOUNTS).
Also the interest which we get on these Accounts annually do not exceed $10K............... I believe that they should not look into the Principle amount (since this was already a tax paid money)
Apart from this no other source of income is there in India.
Do we still need to file this form ??
Ha ha ha.... I initially thought the same logic, unfortunately IRS doesn't think that way. Besides if you have more than 10K in a foreign bank, you MUST file fbar. no matter from where money came.

I just did infopass today... no luck... I still wonder what is the print facility doing ? btw IV sent out the details of all of us to USCIS... Hope they would do something better...
So far my journey to various offices
** Congress man office -- USCIS acknowledges printing delays from 15-30 days.
** Ombudsman office -- Ack ICPS delay , Response waited from USCIS
** Faxed USCIS - no response
** Called USCIS - Same BS - Wait
** Infopass - Nothing can be done, wait
** IV - Info sent , lets wait...
Based on these I have decided and pledged one thing, Will visit my local congressman office / Senator's office will request their help for Immigration reform..every month. I am really fed up. I assume we all are.
Only god knows whatz going on...
I advise and request each one of you to atleast take your time not more than 1 hr every month, there is fabulous material create by IV core on gettign prepped before meeting with senators / Congress man aide(s) or reps itself. More the momemtum we build more awareness and next time when you have issue(god forbid) they will quickly work on it.... Only you can bring change with your case.

B1 people cannot apply GC but L1 people can apply. But many Indian companies like TCS,INfosys,Wipro are not applying gc but bringing people on L1
