Hello,
My employer will be filing for my greencard (labour certification) within the next 2-3 months. I have a valid H1 B visa expiring next year. I was wondering if it is legal to travel outside the country at this stage ?
Any advice would be appreciated.

Nikon today announced the new D70 digital SLR camera. The D70 at $999.00 is Nikon's answer to Canon's 300D. Read the press release here (http://www.dphoto.us/modules.php?op=modload&name=News&file=article&sid=72&mode=thread&order=0&thold=0):
You really have to hunt around to find it mentioned on their site - wierd.
No mention of it's sensor size, presumably 1.5 crop like the D2H. A pricebreakthrough - for Nikon - but I don't see much else of interest. Another DX-format tele-zoom coming. Yawn.
Available "spring 2004"? Seems dumb to put it off that long - so there must be some more development work yet to do. I guess that aligns with PMA, though.

off the top of y head and based on what I've read, a D70 is well worth it, even from a D100. A D2H is now cheap too. With lots of Nikon glass the options are quite good. Even a Kodak SLR/n is a good buy.....

Is it possible to have second H1b visa and Labor certificate approved for employer "B" while working on H1b visa and having Labor and I 140 approved for employer "A" ??

Yes, that is possible. However, you don't need to have a second H1B with employer "B" in order for that employer to apply for LC and 140 for you since LC and 140 are for future jobs.

Hi, Please let me know your thought on my situation. I was on H1 thru Company A. I don't have pay stubs for the last 3 months of 2005 since i was on bench, but got the salary that is mentioned on LCA in pay stubs till end of Sept. When I asked my employer to pay me for the time on bench he said that he has paid the LCA salary and doesn't have to pay.
So having said that, am I in Status or Out of Status?

I am on L1 B visa . I got visa for 3 years. I am working in usa. my I-94 expiration date is september 2009.
My home country is India. can i Go back to india and apply for L1 B again. or can i just cross the border and come back in usa (so that my i-94 get extended).

I believe if employer move to next door i don't think DOL will ask yoru employer to refile, but if your employer move to a different city/town even in the same county, YES he need to start the process all over again.

Thanks for your reponse Panky... I filed my I-140 cocurrently with I-485 with NSC but it got transfered to CSC ...CSC is not even publishing I-140 processing dates.. Wondering if CSC is processing I-140's... I believe that NSC and TSC has sole jursidication over I-140 adjudication.

U.S. Citizenship and Immigration Services (USCIS) announced today that it will begin accepting H-1B petitions (http://www.h1b.biz/lawyer-attorney-1137085.html) subject to the fiscal year (FY) 2011 cap on April 1, 2010. Cases will be considered accepted on the date that USCIS takes possession of a properly filed petition with the correct fee; not the date that the petition is postmarked.

My friend's on her 6th year H1B and it will expire on Sept 10, 2010. A PERM labor was filed and the Labor went into an audit, responses were sent immediately.
If she transfer her H1B to new company.
1. Can she ask for 1 year extension based on her pending labor ? Does she need to wait till the labor gets approved ?
2. Can she use Premium Processing for H1 transfer?
#1 - Yes, as long as the PERM is pending and at least 365 days old at the time of filing H1B extension
#2 - Yes, Premium processing available at the additional cost of $1000
If she transfer her H1B to new company.

--I have EAD and 485 pending. My current status is H1B. But if I use my EAD without marriage...
--Later I get married and I cannot bring her here, but if I wait until my PD becomes current and at which point of time my spouse can be added to 485, so does my spouse need to maintain a valid non-immigrant status to be added to my 485 since she will be out of US.

L1 visa is granted to people who have worked in the home country for the sponsoring company before coming to US. So, if you have worked in XYZ bangalore, you can get an L1 from XYZ to come to US. However, you are obviously working in the US for your present employer, so how could you have worked for the other company in the home country (Example - India)??

I am considering switching my employer.
Currently I have I-140 and labor for GC approved in 2006.
Filed I-485 in July 2007.
My current H-1B expires on December 2009. (9 years on H-1B.... ya that long)
Based on my AC-21 portability after 180 days of I-140 approval, if I move to a new employer and file H-1B transfer, will I get default approval of only upto December 2009, or can I get 3-year extension based on my I-140 approval?

My lawayer upgraded to premium processing for I-140 on June 20th,2007. Will I get a new receipt number or should I keep checking the status for the original I-140 receipt number

I'm in same boat, upgraded to PP on June 1. your new status of I140 will be "We received request for PP". usually they update the online status on friday night. Expect an RFE early next week, they just want more time, so they send some non-sense RFE. RFE resets the 15 day clock.
