The AC21 Letter that one sends after changing a job is not a gaurantee that it is attached to your file(I-485). how do you expect to explain all that you are saying to CIS when they can't do there own work properly.

The only issue I see with using H1/H4 visa for re-entry is that if your I-485 is approved while you are outside US and you use H1/H4 for re-entry, it invalidates your GC and you have to start all over again. You either need to have your GC or an approved AP in hand when you re-enter US in this scenario...

It is very comprehensive list. It covers every field. Graduates of pharmacy, medicine, vet medicine etc are not PhDs. They have to go through special programs to get that degree.

However I am afraid you misunderstood pharmacy, medicine, vet med PhDS with practice professionals PharmD, MD,DVM.The people who made the list of STEM have ignored the fact that Research is highly interdisciplinary. This is unfair for many researchers in biology who should be in the STEM majors but they are not in just because of technical/clerical reasons. I request you all to take a look at this anomaly.

I belong to my state chapter, I am all for meeting whoever to make an impact but it would be great if we can put together good talking points and issues to highlight when we meet these lawmakers.

You have to stick to Software Engineer field in order to take advantage of PD recapture. If you move to Business Development using MBA than its hard to justify same or similar. Find a new job which requires EB2 and show BS+5 to qualify.

OTOH PD recapture does NOT require you to be in the same/similar job.You can file a new LC for the bizdev position, and when filing I-140 request older PD is ported over. Then 'interfile' this new I-140 into the old one on your existing I-485.

I am in a similiar situation. My 485 was approved and my wife got her physical GC but I did not get mine. I took Infopass and the IO raised a SR. My case is from CSC to NSC. I got a response to the SR that my GC was sent and it might have got lost in mail and to file I-90. I called uscis customer rep, talked to 2nd level IO who mentioned that my card was never created and he will raise a SR mentioning the same.
Today I got 2nd FP notice mentioning that I did not give FP for the first one (I gave FP ahead of the scheduled date and verified with FBI if my prints were uploaded or not) and to appear for FP on Jan 11th, 2011. I spoke with a IO on the day this FP notice was sent and IO asked me the date I gave FP and he mumbled some numbers and checked something in the system. He said he had fixed the issue and ignore the 2nd FP. He mentioned his name to me. I should have taken his extension as well. I hope I get the card now or else I need to take Infopass. I emailed nsscfollowup with the scanned copy of the first biometrics notice which has the stamp from the ASC last week only.
I have n't contacted senators and congressmen yet and did not email the scopsscata yet

I have filed through lawyer on 4/23 and my ead expiring on 7/23. After one week of filing I have receiving receipt notice saying we received your application and if biometrics required we will let you know in separate mail but so far I have received any update neither change like LUD.
I have done my biometrics in 9/2009 and I am not sure if I need to do it again for ead renewal.
I have my lawyer contacted CIS and CIS said it may not required biometrics but she was not 100% sure and said she will put a follow up request on my file.
I am not sure what to do? my driver license gets expired with my EAD and will lots of pain if I don't get it on-time?
IV any help or suggestions to come across with this problem?

By returning from the US after your trip, you have proved (ii) to be false (i.e., you did not have intention to immigrate at least at that time). However, that evidence does not prove (i) to be false.
