Mandal ka Kamanadal will do. What this means is that we are back to square one. All the effort, money and energy was spent on making sure that we didnt get screwed any further. Meaning, it hasnt moved us a step ahead but just helped us to retain our positions without going back.

The intent about letting foreigners come to work in US is to fill the gap between the demand and the local availability of skills. It is not about rewarding the foreigners academic skills.
If you want to work here, then get skills in a field where there is a shortage here and you will not have problems with H1 sponsorship.
When you did your Masters degree in US, you should have been more smart in selecting your area of study.
Why should US allow foreigners to work against its citizens when there is no shortage of skill.
Your frustation is understandable from your perspective but definitely not from a US citizens perspective.
This is definitely a wrong advice. People pursue their passion and do their Masters in a field they like. People do not look around which field is giving a Green card. US is not dictating the job market in this global economy.

I'm all for IV!! This is the only organization fighting on behalf of those stuck in GC retrogression. There are some anti-immigrants who come to this website, sign up under Indian identities, and try their darnest best to bog down the efforts....

I would not agree with your interpretation. You are insinuating that a majority of the EB based green cards sponsored by employers are similar to family sponsored green card and also that people are favoured for their nationality.....how did you arrive at this conclusion?
Possibly your exposure may be limited to mom and pop shops and that may be the basis of your analysis....!!

If an H1 gets layed off, how soon must he leave before he is considered illegal status? And for practical purposes, does it matter (ie, is it ever enforced)? Does having severence extend the period (because you're technically still on payroll)?
Canadian, EB3, in 6th year H1, PD nov 04, 140 approved 2/07.
I got different explanations on this from different people and this is my understanding after reading different lawyer/employer opinions and after having gone thru one lay-off:
Technically you have to leave immediately. I am not sure if there is a clear law but lawyers suggest that we have to leave as soon as it is practical. INS/USCIS may be lenient if the time gap after job loss is very short (something like couple weeks). Many people quote a 30 day grace period after losing the job and I asked many lawyers � everyone said that there is no 30 grace period but they also told me that USCIS may be lenient if its less than 30 days and if we can give some reasonable explanation (if and when questions arise at the time of later 485 filing/approving). Does it ever enforced � not sure but its better to be on the cautious side. Severence period does not extend the period. The day we stopped going to office (stopped providing service to employer) is our final day.

First of all let us applaud the effort and commitment of needhelp and the many other committed members of Immigration Voice. I think it takes a lot to sacrifice personal time for an effort that others may benefit from but who may not see or recognize it.
Having said that some of the posts on this forum are emotional responses. I think we need to keep in perspective that "galvanizing people to a goal" is one of the most difficult things to accomplish. IMHO chastising "wake up" call speeches is not going to help. That is not to say that some of what is being said is not right. But I ask why should we chastise anybody?
At the moment I seem to be the only member of the NM Chapter (hopefully that will change). But frankly, it took me more than a year to buy into Immigration Voice and it's value. I have only recently started getting involved. As I see it, if someone visits this website (even for an update or to read forum discussions - as I did) they see value in coming here. Recognition of value brings commitment. But that also takes time. Maybe a lot of people cannot commit in ways we want them to commit. Maybe a lot of people choose not to. We should wish all of them the very best of luck.

On the other side, I was pleasantly surprised that in 10 days we were able to collect 2/3 rds of our target for the omnibus bill. That is an awesome feat. People can choose to be part of it or not. It is really up to them. I know I will have stories to tell.

Well, I hope mine gets resolved sooner than 6-8 months! My EAD is already expired and I could not apply since there was nothing in the application where I could show my status which is PR.
TravInd, you are right about people not knowing the priority dates and not aware the GC was a mistake. In fact, I still don't know for sure if mine was a mistake. I will know only when I find it out through the lawyer. My previous lawyer who worked on my GC case said congratulations and everything was fine. I am eager to find out if it was a mistake on my own.
Just a hypothetical scenario.
Say an applicant is having PD of March 2005.
His/Her 485 gets approved with PD of Jan 2005. (may be a typo by CIS data entry person)
However at the time of approval, PD is current till June 2005. (he or she should have been approved anyway).
What would be the scenario? Thoughts? Any one????

I m a new applicant for EB 3 gc born in india.....just starting my process......with my PD being sometime in later half of 2009,do u think canada is a better option?......EB 3 india right now looks like a good 10-12 years wait time!!.......pls advice about canada immigration and is it a viable option?
No, Canada is not a better option. INDIA!! is a better option. You got to get it out of your mind that you need to go somewhere. It is different in the US because you have some industries and jobs here that you cannot get anywhere else. Also a certian lifestyle. But common Canada, eastern Europe, Africa... you guys are nuts.
India is a MUCH better option than anywhere else except maybe if you get a real good job in China. As far as I am concerned if nothing happens here I am headed back to my hometown-Bangalore, India.
I have much better lifestyle and opportunities than Canada or even western europe! Period.

My wife and I got involved with IV activities/volunteering about 2 months before the rally....and we are very glad we did!
Its been a very rewarding and learning experience....after meeting with the lawmakers- it has fortified our belief in IV and renewed our enthusiasm about the process. After reading Logiclife's post I am convinced that active participation is the key to achieving success!
We plan on continuing our efforts - turning sceptics into believers - it is especially needed in the DC/VA/MD!

If they never updated the lawyer info....(AC21 papers being lost is not unusual at all, it happens commonly, as there is no set form for it, mail room does not know what to do with it and so it gets misplaced). However, even if they did not have AC21 info, they would have sent an RFE or at least NOID. All these could be LOST if they went to OLD attorney.
So Infopass is a good idea. To at least get this info and also to get the actual denial notice which may have to to the old attorney as well (to see on what grounds they denied it so you can file MTR accordingly).
Of course, a good attorney is a must.
All in all, I think, it should be ok at the end of the day (just a painful waiting period full of uncertainty) unless they revoked it based on some misrepresentation.

I don't personally think we had much media coverage except some hidden links, can we post some paid adds where everyone can get know what we are addressing in here i.e., on the front page of google, yahoo, msn, cnn, etc. I know some people might have second thoughts as it involves $ but I'm ready for it to get public attention. There is a thin line between legal and illigal and they are ready to club both together for their benefits. I'm starting to wonder how many people know what is going on, we have to educate them first.
I support this, and am ready to contribute $, time and sweat. We need visibility. Our main goal is to EDUCATE people, (and even the government!) that we are the totally opposite of illegals! The Congressman who spoke at our rally had a lot of good intentions, but then he started talking about how "illegal immigrants are also people who look like me"(meaning Caucasian/White) and he mentioned the thousands of illegal Irish immigrants living in Boston, who have a group called "Legalize the Irish Now".... those comments had no place in our rally of highly-skilled LEGAL immigrants! And that was a Congressman talking. EDUCATION IS THE WORD, and we need to invest in it NOW!! Let's go guys! Ideas!???

Sorry that I could not reply sooner. In this case, I went ahead and did an Info Pass appointment. The officer there went ahead and gave a 1-year temporary stamp and said he was ordering card production. This was in July and I am still waiting. My lawyer said "congrats"! No idea how to handle this going forward. What happened to your case?
Well, I had the same situation. Me and my wife, we both received our green cards one fine day. Needless to say I was overjoyed for few days until my attorney called and explained the cons. He told me that this was clearly due to clerical error. Legally, they cannot approve your petition until PD is current. There are some new QC systems in place at the CIS and you should not risk your status if you have an honest intention of staying in this country.
He said CIS can come back any day and revoke the green card if the system realizes that your card was illegally issued. At that time you may not have any option but to return to your home country within days.
So, my attorney contacted AILA and through them got hold of the immigration officer who had approved my case. CIS immediately recognized the error and asked me send the cards back so it can be destroyed. I finally got a letter from the Director of Homeland Security apologizing for the error and appreciating my honesty (well I wasn't that honest really, it was my attorney who brainwashed me).
On a lighter note � I took a photocopy of my green card and kept it in file; I stare at it sometime when I am frustrated�.
